An Act to enable Bailiffs of the Courts of Requests
and of Pe t ty Sessions respectively to sell by

Auction without a License. [27th July, 1849.]

W H E R E A S by an Act passed in t h e e leventh year of t he re ign of
H e r Majesty Queen Vic tor ia in t i tu led " An Act to regulate

" the licensing of Auctioneers and the collection of Duties on Property " sold by them" it was amongs t o ther t h ings enacted t ha t from and after t he first day of J a n u a r y one t housand e ight h u n d r e d and forty- eight no person wha tever who a t any t ime or t imes thereaf ter should exercise t he t r ade or bus iness of auct ioneer or seller by commission a t any sale of any es ta te goods or effects wha tever by outcry knock ing down of h a m m e r candle lot parcel or any other mode of sale by auc t ion or whereby t h e highest bidder is deemed the purchaser or who should net in t he capaci ty of an act ioneer or seller by commission should deal in sell or p u t u p to sale or re-sell any es ta te goods or effects whatsoever by publ ic sale or by way of auc t ion as aforesaid w i thou t previous ly hav ing t aken out a l icense A n d whereas it is expedient t h a t t he Bailiffs of t he Cour t s of Reques t s and also of the Cour t s of P e t t y Sessions t h r o u g h o u t t h e Colony should have power to sell by publ ic auc t ion goods or p roper ty of any descript ion t a k e n in execut ion u n d e r process issued from t h e said Cour ts respectively Be i t therefore enacted by his Excel lency t h e Governor of N e w South W a l e s wi th t h e advice and consent of t he Legislat ive Counci l thereof Tha t t h e Bailiffs of t h e Cour ts of Beques t s and also of the Cour t s of P e t t y Sessions in t he said Colony shall have power and au tho r i t y to sell by publ ic auct ion all goods and o the r p roper ty of wha tever k ind t aken by them respectively in execut ion by v i r tue of process issued from the said Cour ts respec- tively wi thou t t ak ing out an Auct ioneer ' s License anyth ing in the said

reci ted Act to the cont rary no twi ths tand ing .

2. A n d whereas it is deemed expedient t ha t all leases of Crown Lands and other Crown proper ty may be sold by auct ion by such officers of t h e Government as may be author ized for t h a t purpose by t h e Governor and also all goods and chat te ls belonging to in tes ta te es ta tes Be it enacted That from and after t he pass ing of this Act all leases of Crown Lands or any proper ty wi th in the said Colony belong­ ing to the; Crown or to intestate estates may be sold by auct ion by any Clerk of the Bench Chief Constable or other person duly author ized in t ha t behalf by the Governor of said Colony for t he t ime being wi thou t t a k i n g out any license or bond under the provisions of the said recited Act .
