Act N o . 1 9 3 , 1979 .

An Act to amend section 4 (2) of the Bail Act, 1978, in relation to persons dealt with pursuant to certain provisions of the Community Service Orders Act, 1979. [Assented to, 21st December, 1979.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Bail (Community Service

Orders) Amendment Act, 1979".

2.       (1 ) Except as provided by subsection ( 2 ) , this Act shall

commence on the date of assent to this Act.

(2) Section 3 shall—

(a)

where the day appointed and notified under section 2 (2) of the Bail Act, 1978, is earlier than the day appointed and notified under section 2 (2) of the Com­ munity Service Orders Act, 1979—commence on the day appointed and notified under section 2 (2) of the Community Service Orders Act, 1979; or

(b)

where the day appointed and notified under section 2 (2 ) of the Bail Act, 1978, is not earlier than the day appointed and notified under section 2 (2) of the Com­ munity Service Orders Act, 1979—commence on the

day appointed and notified under section 2 (2) of the
Bail Act, 1978.

3.      The Bail Act, 1978, is amended—

(a)

by omitting from section 4 (2) (c) the words "pending; and" and by inserting instead the word "pending;";

(b)

by omitting from section 4 (2) (d) the word "offence." and by inserting instead the words "offence; and";

(c)

by inserting after section 4 (2) (d) the following paragraph :—

(e)

a person who may appear or be brought before a court pursuant to section 18 (1) (a) (iii) or (b) or 25 (1) (b) (ii) or (c) of the Community Service Orders Act, 1979.
