CaseChat Overview and Summary
The Full Bench of the Fair Work Commission considered the arguments presented by both parties and examined the agreement's compliance with the relevant legislative provisions. The Commission assessed whether the agreement was properly negotiated and if it met the standards for approval, including whether it contained minimum wages and conditions of employment, and whether it was in the best interests of the employees. The Commission found that the agreement was procedurally valid, as it was made in good faith, without coercion, and after proper negotiation. The agreement was also substantively valid, as it contained the required minimum terms and conditions, and it was in the best interests of the employees.
