[ASSENTED TO 22ND OCTOBER, 1929.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Babinda State Short title. Hotel Sale Act of 1929."

In this Act, unless the context otherwise indicates or requires, the following terms have the meanings respectively assigned to them, that is to say:- Babinda Sta.te Hotel, or Hotel. "Babind9 State Hotel" or "Hotel"-" The Babinda State Hotel," situated at Babinda in the said State, and the premises, goodwill, and all stock-in-trade, furnishings, fittings thereof or appertaining thereto, together with nIl machinery, chattels, and appurtenances used therein or in connection therewith, and any rights, titles, or interest in respect of the hotel or in respect of the leases, particulars whereof appear in the Schedule, or such [lron as may be agreed upon, possessed by the Commissioner; Commis. sioner. " Commissioner" - The Commissioner for Trade appointed unner *" The State Enterprises Act of 1918"; Court. " Court " -The Licensing Court as defined by the Liquor Acts; Liquor. Babinda State Hotel Sale Act. ... .. - ~. - - - - ~ ~ ~ . - - - - - - - - - - - - ~ - - - -- - (b) Such license shall forthwith be recorded as a licensed victualler's license in the register of licenses of the licensing court constituted under the Liquor Acts for the licensing district of Cairns constituted under the Liquor Acts, and thereupon the following consequences shall ensue ;- (i.) The Babinda State Hotel shall be and become licensed premises within the meaning of and under and subject to the provisions of the Liquor Acts; (ii.) The said license shall be a licensed victualler's license under the Liquor Acts, and may be dealt with under and in accordance with those Acts a~ cordingly ; (iii.) The Commissioner, or, in the event of his making an appointment under the next succeeding section, the person so appointed, so long as the Commissioner shall retain the said license, and thereafter the holder thereof for the time being, shall be a licensed victualler within the meaning and subject to the provisions of the Liquor Acts. 5. The Commissioner may appoint any person to Commis- manage such hotel in his place and on his behalf. sioner may appoint person to manage hotel. 6. The Governor in Council may from time to time, Regulations. by Order in Council, provide for all or any purposes, whether general or to meet particular cases, that may be convenient for the administration of this Act or that may be necessary or expedient to carry out the objects and purposes of this Act, including the issue of such title as he may deem necessary to the owner for the time being of the Babinda State Hotel, and including the vesting in such person as he may think fit of the water supply and appurtena,nces thereto at present used and enjoyed in connection with the Babinda State Hotel and the granting of any necessary easements and rights of way therefor, and where there may be in this Act or in the Liquor Acts or State Enterprises Act no provision or no sufficient provision in respect of any matter or thing adequate, necessary, or expedient to give effect to this Act, providing for and supplying such omission or insufficiency.
