MR J.D. SMITH:   May it please the Court, I appear for the respondent, the applicant on the motion.  (instructed by Australian Government Solicitor)

HAYNE J:   Could we have the respondent to the motion, the applicant, called?

MR SMITH:   Yes, your Honour.

HAYNE J:   Call Omar Sharif Baban, please.

COURT OFFICER:   No response, your Honour.

HAYNE J:   Yes, thank you.  Now, Mr Smith, you move, do you, for an order dismissing the application for want of prosecution?

MR SMITH:   Yes, I do, your Honour.  On that application, I read the affidavits of Angela Margaret Nanson.

HAYNE J:   There being no appearance for the applicant, the order dismissing the application, that is, the application for special leave for want of prosecution, should be made together with an order for costs.  There will be orders in those terms.  Adjourn the Court to 2.15 on Tuesday next, 12 August, in Adelaide.

AT 12.38 PM THE MATTER WAS CONCLUDED
