“Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU)
v

UGL Operations and Maintenance (Services) Pty Ltd

(B2023/483)

VICE PRESIDENT CATANZARITI

MELBOURNE, 24 MAY 2023

Application to extend the 30 day period in relation to B2023/312

  1. On 19 May 2023, the “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) (Applicant) made an application to the Fair Work Commission (the Commission) pursuant to s. 459(3) of the Fair Work Act 2009 (Cth) (the Act) to extend the 30 day period for protected action authorised by a protected action ballot order, PR760952 made on 6 April 2023. The Order applies to certain employees of UGL Operations and Maintenance (Services) Pty Ltd (the Respondent).

  1. The ballot result, by which a majority of the relevant employees endorsed the proposed forms of protected industrial action, was declared on 24 April 2023. Pursuant to s. 459(1)(d)(i) of the Act, the 30 day period for protected action commenced on the date of the declaration of the results of the ballot and therefore expired at midnight on 23 May 2023.

  1. On 23 May 2023, the Respondent advised the Commission via email that it does not oppose the AMWU’s application to extend the 30 day period for protected industrial action. Accordingly, I have determined the matter on the basis of the documentation filed.

  1. In addressing s.459(3) of the Act, this application is made by the AMWU who is the Applicant for which the protected action ballot order was issued. Furthermore, the period specified in s.459(1)(d)(i) has not been previously extended.

  1. On that basis and on the material before me, I am satisfied that each of the relevant requirements of s.459 of the Act have been met and that a 30 day extension is appropriate. As the 30 day period expires at midnight on 23‎ ‎May‎ ‎2023, the extension period will operate from 23‎ ‎May‎ ‎2023.

  1. An order has been separately issued in PR762462.

CaseChat Overview and Summary

The Australian Manufacturing Workers’ Union (AMWU) sought an extension of the 30-day period for protected industrial action under section 459(3) of the Fair Work Act 2009 (Cth) against UGL Operations and Maintenance (Services) Pty Ltd. The AMWU had previously secured a protected action ballot order, PR760952, on 6 April 2023, which authorised a majority of the relevant employees to engage in industrial action. The 30-day period for protected action, as mandated by section 459(1)(d)(i) of the Act, began on 24 April 2023, the date the ballot results were declared, and was set to expire on 23 May 2023. The AMWU applied to extend this period, which UGL did not oppose.

The legal issues before the Commission included whether the AMWU's application complied with the requirements of section 459(3) of the Fair Work Act, and whether the 30-day period for protected action could be appropriately extended. Given that the 30-day period had not been extended previously, the Commission considered if the application met the necessary criteria. The Commission noted that UGL had not opposed the extension and that the AMWU had complied with the procedural requirements of the Act. Consequently, the Commission determined that the AMWU's application met the requirements for an extension.

Based on the information presented, the Fair Work Commission found that the AMWU had satisfied the necessary criteria for extending the 30-day period for protected industrial action. The Commission issued an order granting the AMWU's application for an extension, which would commence from 23 May 2023, thereby extending the period for protected action beyond the initial expiration date. The decision was documented and issued in PR762462.
