Proposed protected action ballot by employees of U.C.P. Australia Pty Ltd t/as United Pumps Australia.
[1] This is an application for a protected action ballot of members of “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) employed by U.C.P. Australia Pty Ltd T/A United Pumps Australia.
[2] This application was filed by the AMWU on 1 June 2012.
[3] A hearing was conducted on 5 June 2012 as a result of the employer indicating it wished to be heard in relation to the application. At that hearing Mr Barry Terzic for the AMWU gave undertakings in respect of bargaining and the matter was adjourned to allow this to occur.
[4] I understand that those undertakings were complied with by the AMWU.
[5] By email on 15 June 2012 the AMWU wrote advising that it had obtained written advice from the Australian Industry Group representing the employer that the employer no longer objected to the application.
[6] In the circumstances I have decided to determine the matter on the papers without holding a further hearing.
[7] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AMWU has issued in conjunction with this decision.
