Proposed protected action ballot by employees of Trico Products Pty Ltd.

[1] This is an application for a protected action ballot of members of the “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) employed by Trico Products Pty Ltd (Trico). This application was filed by the AMWU on 9 July 2012.

[2] This matter was listed for hearing on 17 July 2012 on the basis of verbal advice from Mr Peter Avenell of Trico that indicated the company may have grounds for objecting to the application.

[3] However, on 16 July 2012 I received written advice from Mr Peter Avenell that Trico withdraws its objection in this matter.

[4] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AMWU has issued in conjunction with this decision.
