Proposed protected action ballot by employees of Saunders International Limited.

[1] The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (“AMWU”) has made an application, pursuant to s.437 of the Fair Work Act 2009 (“the Act”), for a protected action ballot order in relation to certain employees of Saunders International Limited (“Saunders”).

[2] The matter had been listed for hearing today. Prior to the hearing, the solicitors acting for Saunders confirmed in writing that their client consents to the application. The solicitors further advised that, in the circumstances, Saunders would not be appearing at the hearing. In consequence, the AMWU made a subsequent application, to which I acceded, for the application to be determined on the papers.

[3] On a consideration of the material filed in support of the application, I am satisfied the requirements of s.443(1) of the Act have been met and, thereby, that the proposed order must be made. The order (PR527159), which is based on the AMWU’s draft order, has been issued in conjunction with this decision.
