Proposed protected action ballot by employees of Nissan Motor Company (Australia) Pty Ltd.

[1] This is an application for a protected action ballot of members of “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) employed by Nissan Motor Company (Australia) Pty Ltd (Nissan).

[2] Mr Sean Edwards advised my chambers by email on 7 December 2012 that the company does not oppose the application.

[3] The AMWU has supplied my chambers with a signed declaration that it has been and is genuinely bargaining with Nissan.

[4] In the circumstances I have decided to determine the matter on the papers without a hearing.

[5] I am satisfied that the requirements of the Act have been met and that accordingly an order must be made. An order based on the draft provided by the AMWU has been issued in conjunction with this decision.
