Proposed protected action ballot by employees of Nationwide Newspapers Pty Limited and others.

[1] This decision concerns an application made pursuant to s.437 of the Fair Work Act 2009 (FW Act) by the “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU), for a protected action ballot order, in relation to certain employees of Nationwide Newspapers Pty Limited and others (Employer).

[2] I rely on the submissions made by Ms Ford of the AMWU, and Mr. Jolly for the Employer in the Hearing before me on 14 October 2011. I am satisfied that the requirements in s.443(1) have been met and that, accordingly, an order must be made.

[3] An order PR515770 based on the draft order provided by the AMWU, and not opposed by the Employer, will issue in conjunction with this decision.
