Proposed protected action ballot by employees of Liquip International Pty Ltd (Aviation Division).

[1] This is an application for a protected action ballot of members of “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) employed by Liquip International Pty Ltd (Aviation Division).

[2] Ms Emily Henderson of the Australian Industry Group, representing Liquip International Pty Ltd, advised my chambers by email dated 29 October 2012 that the company does not oppose the application. I accept that this advice confirms that it is the view of the respondent that the AMWU has been, and is, genuinely trying to reach an agreement.

[3] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[4] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AMWU has issued in conjunction with this decision.
