Alleged dispute concerning clause 13 and clause 44 of the agreement.
[1] Today in Fair Work Australia, I held a conference with the Company and employee representatives regarding a dispute concerning clauses 13 and 44 of the BAE Systems Australia Defence Pty Ltd Maritime Collective Agreement 2010-2013 (the agreement).
[2] As a result of that conference, and pursuant to clause 44 of the agreement, I have directed that both the Company and the joint unions nominate 1 person each, independent of this dispute, who will participate in a small working group with me with the intent to provide a draft Inclement Weather document. Nominations are to be made to me prior to the Easter break.
[3] It is intended that this group of 3 will meet over 4 to 5 weeks commencing 2nd May 2011. Part of the process for this group will be to visit the Williamstown shipyard. Both parties will have the opportunity to provide relevant literature supporting their position.
[4] The resulting draft document will be provided to both parties for consideration. If agreed, this document will be inserted into the collective agreement by way of a variation. Should either party not accept this draft document, or should we be unsuccessful in developing a draft document within the allotted time frame, or an extended time frame agreed to by the parties, then I will proceed to arbitrate on the matter.
