Proposed protected action ballot by employees of Amcor Packaging.

[1] This is an application pursuant to s.437 of the Fair Work Act 2009 (the Act) by “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) (“Union”) for a protected action ballot order in relation to certain employees of Amcor Packaging (Australia) Pty Ltd who are employed at the Rocklea site.

[2] The Company, Amcor Packaging (Australia) Pty Ltd has advised by email on 7 November that it is not contesting the application.

[3] In the circumstances I have decided to determine the matter on the papers as I am satisfied it is not necessary to hold a hearing.

[4] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order [PR531122] based on the draft order provided by the AMWU has been issued in conjunction with this decision.
