[1] On 8 August 2013 the "Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union" known as the Australian Manufacturing Workers' Union (AMWU) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the AMWU.
[2] The particulars set out alterations to rule 41.7 of the rules of the AMWU.
[3] On 11 October 2013 the Fair Work Commission write to the AMWU seeking confirmation whether the National Conference meeting held on 25 July 2013 had been held in accordance with the rules, whether the meeting had been quorate, whether valid notice had been provided, and whether a notice of the alterations had been published on the AMWU’s web site in accordance with regulation 126(1)(b) of the Fair Work (Registered Organisations)
Regulations 2009 (the Regulations).
[4] On 22 October 2013, the AMWU wrote to the Fair Work Commission confirming that the National Conference meeting had been held in accordance with the rules, that the meeting was quorate, that valid notice had been provided, and that the notice had been published in accordance with regulation 126(1)(b) of the Regulations.
[5] On the information contained in the notice and further correspondence, I am satisfied the alterations have been made under the rules of the organisation.
[6] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise
agreements, and are not otherwise contrary to law. I certify accordingly under subsection
159(1) of the Fair Work (Registered Organisations) Act 2009.
