Arrangement for conduct of election.

[1]        On 29 August 2016 the “Automotive, Food, Metals, Engineering, Printing and

Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU)

lodged with the Fair Work Commission the prescribed information in relation to an election

for the following offices:

[2]        A casual vacancy has arisen in relation to each of the offices described above except in

the case of one (1) of the New South Wales Manufacturing Membership Delegates to State

Conference, which was not filled, due to lack of eligible nomination, in either the previous

scheduled election E2014/202 or the subsequent election E2015/293.

[3]        I am satisfied that an election for the abovenamed offices is required to be held under

the rules of the organisation and, under subsection 189(3) of the Fair Work (Registered

Organisations) Act 2009, I am making arrangements for the conduct of the election by the

Australian Electoral Commission.

This office is variously described in the rules of the organisation: e.g. in rules 50.23(e)(i) and 50.24(g) and (h) as

“committee members” (on the Regional Council); in rule 50.25(f) as “persons holding …positions on the Regional

Council”; in rule 53, Part C as “Committee State Members” (in respect of the Vehicle Division), “Delegates to Regional

Council” (in respect of the Food and Confectionery Division) and “Regional Councillors” (in respect of the Printing

Division). The predominant historical colloquial usage within the organisation, including in the lodgement of prescribed

information appears to have been “Regional Councillor” or some variant of it and past Decisions of the Delegate appear

for the most part to reflect the nomenclature used in the prescribed information. This Decision continues this practice in

respect of this office but includes, for the avoidance of doubt, the /respective descriptor appearing in rule 53, Part C.
