Note Printing Australia Award 2016.
[1] In our decision of 11 September 2014 1 we determined that a modern Note Printing Australia enterprise award should be made.
[2] At the time of making that decision, we noted that the parties agreed on the majority of award terms and advised that a member of the Full Bench would convene of conference of the parties to assist fine tuning the terms of the award before it is ultimately made by the Full Bench.
[3] Deputy President Smith subsequently conducted a conference with the parties to determine the final draft of the award to be made.
[4] The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) advised that the parties have agreed upon the new classifications and minimum pay schedule, the inclusion of unions in the coverage clause and the inclusion of arbitration in the dispute resolution procedures. The AMWU requested that the matters of unions in the coverage clause and the inclusion of arbitration in the dispute resolution procedures be arbitrated by the Commission based on submissions made during the hearing and further submissions in writing.
[5] Further consideration of those matters has been undertaken and the parties have revised certain provisions to ensure that the terms of the award comply with minimum rate requirements. The Commission confirms its position in relation to awards generally that the coverage clause be express to cover employees of specified classes. There is no purpose in making reference to registered organisations. The Commission notes that the agreed dispute settlement provision permits resolution by agreement, mediation, conciliation or arbitration.
