Proposed protected action ballot by employees of Agilent Technologies (M) Australia Pty Ltd.

[1] This is an application for a protected action ballot of members of “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) employed by Agilent Technologies Australia (M) Pty Ltd (Agilent).

[2] This application was filed by the AMWU on 28 May 2012.

[3] My Associate emailed Ms Anne Foley of Agilent on 29 May 2012 asking Agilent to indicate its position in relation to this application. Ms Foley responded by email late on the following day that the company does not oppose the application.

[4] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AMWU has issued in conjunction with this decision.
