Application for approval of the AMWU and the Vibro-Pile (Aust) P/L Collective Bargaining Workshop Agreement 2011.

[1] This decision relates to an application for approval of a single-enterprise agreement known as the AMWU and the Vibro-Pile (Aust) P/L Collective Bargaining Workshop Agreement 2011 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) and was made by “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU).

[2] This application was not made within the lodgement time limit established by s.185(3)(a) of the Act.

[3] For the reasons given on transcripttoday I do not think that, in all the circumstances, it fair to extend the period in which to lodge the application.

[4] The application is dismissed as being out of time.
