1    Name

This instrument is the Automatic Mutual Recognition (Australian Capital Territory) (Notification Requirement—Commercial Pesticide Operators) Determination 2021.

2    Commencement

(1)    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under subsection 42J(4) of the Mutual Recognition Act 1992 of the Commonwealth.

5    Definitions

In this instrument:

Act means the Mutual Recognition Act 1992 of the Commonwealth.

covered activity means an activity of the kind mentioned in schedule 1, table 1.2, item 29 of the Environment Protection Act 1997 of the Australian Capital Territory authorised to be carried on under an environmental authorisation under that Act.

local registration authority means the Environment Protection Authority established under the Environment Protection Act 1997 of the Australian Capital Territory.

6    Notification requirement

For subsection 42J(4) of the Act, a person intending to carry on a covered activity in the Australian Capital Territory must notify the local registration authority before the person begins to carry on the activity.
