CaseChat Overview and Summary
The Commission found that the agreement met the requirements of the Act, and that it provided for fair and reasonable terms and conditions of employment. The Commission noted that the agreement contained provisions that were consistent with the National Employment Standards, and that it provided for a number of benefits for the employees, including increased wages and improved working conditions. The Commission also found that the agreement was in the best interests of the employees, as it provided for a number of benefits that were not available under the applicable award or other agreement. The Commission concluded that the agreement should be approved and registered as a registered agreement under the Act.
The Commission made an order approving and registering the Austunnel Pty Ltd Enterprise Agreement 2016 as a registered agreement under the Fair Work Act 2009. The agreement was to be registered from the date of the order, and was to remain in force until 30 June 2021, unless earlier terminated in accordance with the provisions of the Act. The Commission also made an order that the agreement was to be given to the parties, and that a copy of the agreement was to be lodged with the Fair Work Ombudsman.
