AUSTUDY Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Student and Youth Assistance Act 1973.

1.   Commencement

1.1   These Regulations commence on 1 July 1997.

2.   Amendment

2.1   The AUSTUDY Regulations are amended as set out in these Regulations.

3.   Regulation 87 (What are the deductions for children?)

3.1   Subregulation 87 (1):

Omit all the words before paragraph (a), substitute:

(1) The deductions for children are available for a child (except the student) who:”.

3.2   Paragraph 87 (1) (a):

Omit “a parent”, substitute “the parent, or parents, of the student”.

3.3   Subregulation 87 (2):

Omit all the words before paragraph (a), substitute:

(2)The amount of a deduction for a child for whom a deduction under subregulation (2A) is not available is:”.

3.4   After subregulation 87 (2), insert:

(2A) In respect of the application for AUSTUDY of a tertiary student who qualifies for the away-from-home living allowance, the amount of the deduction for each other child who is a tertiary student who qualifies for that allowance is $7,400.”.
