AUSTUDY Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Student Assistance Act 1973.

1.   Amendment

1.1   The AUSTUDY Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2. Regulation 41 (Previous study:

time spent on a course)

2.1   Subregulation 41 (1):

Omit “If a student has not completed a tertiary course, the”, substitute “A”.

2.2   After subregulation 41 (1A), insert:

“(1B)

In determining time already spent in full-time study, the time taken by the student to complete a course is taken to be no longer than the minimum time in which the course could have been completed.”.

2.3   Subregulation 41 (2A):

Omit the subregulation.

3.   Schedule 6 (Fringe benefits)

3.1   Subclause 6 (1), note:

Omit the note, substitute:

“[Note: If the person is a member of a couple, the value of the car benefit must be halved in certain circumstances (see subclause (2).]”.

3.2   Subclause 16 (1), note (first occurring):

Omit the note, substitute:

“[Note: For the meaning of ‘housing loan’, see clause 17.]”.

3.3   Clause 17:

Omit the note, substitute:

“[Note: For the meaning of ‘relevant interest’, see clause 18.]”.
