AUSTUDY Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Student and Youth Assistance Act 1973.

1.   Commencement

1.1   Regulation 5 is taken to have commenced on 4 November 1996.

 The remaining provisions of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Amendment

2.1   The AUSTUDY Regulations are amended as set out in these Regulations.

3.   Application of amendments

3.1 The amendments of the AUSTUDY Regulations made by subregulation 9.2 and regulations 12, 14 and 15 apply only in relation to applications for AUSTUDY for a period starting on or after 1 January 1997.

4.   Regulation 8 (AUSTUDY is payable until when?)

4.1   After paragraph 8 (1) (ea), insert:

“(eb)

A student:

(i)  is studying a course subject (other than a year-long subject) in the first semester of a year of study; and

(ii) in that semester, contravenes the progress rules set out in regulation 41 for that course

the last day of that semester”.

5.   Regulation 18A (What is excluded from assets? (e) farm assets in an “exceptional circumstances drought affected area”)

5.1   Subregulation 18A (2) (definition of ‘drought recovery period’):

Omit “6 months”, substitute “1 year”.

6.   Regulation 22 (Excluded: (b) students getting other pensions and allowances)

6.1   Subregulation 22 (2):

Omit the subregulation, substitute:

(2)A student cannot get AUSTUDY for a period in the year before the start of a course he or she intends to undertake if, for that period, the student receives:

(a) newstart allowance, sickness allowance, special benefit, partner allowance or parenting allowance, under the Social Security Act 1991; or

(b) youth training allowance under the Student and Youth Assistance Act 1973.”.

7.   Regulation 38 (Levels of tertiary courses)

7.1   Paragraph 38 (1) (c):

Omit “associate diplomas”, substitute “associate degrees, associate diplomas”.

7.2   Paragraph 38 (5) (a):

Omit the paragraph, substitute:

“(a) an associate degree course;

(ab) an associate diploma course;”.

8.   Regulation 41 (Previous study: time spent on a course)

8.1   Subregulation 41 (1):

Omit “in a year of study”, substitute “in a year or semester of study (as the case requires)”.

9.   Regulation 61 (What is the maximum living allowance?)

9.1   Paragraph 61 (1) (a):

Omit “(except a student to whom paragraph (ab) applies)”.

9.2   Paragraph 61 (1) (c):

Omit the table, substitute:

Omit “authority; or”, substitute “authority.”.

11.   Regulation 91 (Concession to the parental income test: (c) pensions and allowances)

11.1   Subparagraph 91 (1) (d) (ii):

Omit “parenting allowance”, substitute “benefit parenting allowance”.
