The court also noted that the defendant had not raised any other issues that would prevent the use of summary procedure.

The court made an order that the terms of the settlement agreement be enforced using summary procedure. The court ordered that the defendant pay the plaintiff the sum of $50,000, together with interest and costs. The court also ordered that the original proceeding be reinstated and that judgment be entered by consent in favour of the plaintiff.
