REGULATIONS UNDER THE AUSTRALIAN UNIVERSITIES COMMISSION ACT 1959-1971.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice or the Federal Executive Council, here by make the following Regulations under the Australian Universities Commission Act 1959-1971.

AUSTRALIAN UNIVERSITIES COMMISSION REGULATIONS

Citation.

1. These Regulations may be cited as the Australian Universities Commission Regulations.

Definitions.

2. In these Regulations, unless the contrary intention appears—

“the Act” means the Australian Universities Commission Act 1959-1971;

“the Chairman of the Commission” includes a full-time Acting Chairman within the meaning of section 7 of the Act;

“a Committee” means a Committee to assist the Commission appointed by the Minister under section 17 of the Act;

“the Deputy Chairman of the Commission” includes a full-time Acting Deputy Chairman within the meaning of section 7 of the Act.

Travelling allowance—Australia.

3.—(1.) Subject to regulation 4 of these Regulations, where—

(a) a member of the Commission; or

(b) a person, not being a member of the Commission, who is a member of a Committee,

is, in the course of the performance of his duties as a. member of the Commission or the Committed, as the case may be, necessarily absent from the city or town in which he ordinarily resides, travelling allowance is payable to him in respect of the period of his absence.

(2.) Travelling allowance is payable to the Chairman of the Commission under sub-regulation (1.) of this regulation—

(a) in respect of travel during the period from and including the ninth day of December, 1971, to and including the sixteenth day of May, 1972—at the rate of Twenty-eight dollars per day; and

(b) in respect of travel after the sixteenth day of May, 1972—at a rate of Thirty-four dollars per day.

(3.) Travelling allowance is payable to—

(a) a member of the Commission, other than the Chairman of the Commission; and

(b) a person, other than a member of the Commission, who is a member of a Committee,

in respect of travel on the twenty-fourth day of January, 1972, or any subsequent day, at the rate of twenty-five dollars a day.

(4.) Travelling allowance payable under this regulation is in addition to, and does not include, the cost of conveyance.

(5.) Sub-regulations (1.) and (3.) of this regulation apply in relation to a member of the Commission who is also a member of a Committee as if duties performed by him as a member of the Committee were performed by him as a member of the Commission.

Travelling allowance—Overseas.

4.—(1.) Where—

(a) a member of the Commission is engaged outside Australia, with the approval of the Commission, on business of the Commission; or

(b) a member of a Committee is engaged outside Australia, with the approval of the Committee, on business of the Committee,

he is entitled to be paid such allowances as he would be entitled to be paid—

(c) in the case of the Chairman of the Commission—if he were the Permanent Head of the Department of Education and Science; or

(d) in any other case—if he were an officer of the Public Service of the Commonwealth and were included in the Second Division.

(2.) A member of the Commission or a member of a Committee who is entitled to be paid travelling allowance in respect of a period under sub-regulation (1.) of this regulation is not entitled to be paid travelling allowance in respect of that period under regulation 3 of these Regulations.

(3.) Travelling allowance payable under this regulation is in addition to, and does not include, the cost of conveyance.

Sitting fees.

5.—(1.) Subject to the next succeeding sub regulation, a member of a Committee is entitled to be paid, for each day on which he attends a meeting of the Committee, an allowance of—

(a) in the case of the Chairman of the Committee—

(i) if the duration of the meeting is not less than three hours—Forty dollars; or

(ii) if the duration of the meeting is less than three hours—Twenty-five dollars; or

(b) in any other case—

(i) if the duration of the meeting is not less than three hours—Thirty-five dollars; or

(ii) if the duration of the meeting is less than three hours—Twenty dollars,

(2.) An allowance is not payable under the last preceding sub-regulation to a member of a Committee who is—

(a) the Chairman of the Commission;

(b) the Deputy Chairman of the Commission;

(c) an officer of, or temporarily employed in, the Public Service of the Commonwealth; or

 

(d) an officer of, or temporarily employed by, an authority of the Commonwealth who is required by the terms of his employment to give the whole of his time to the duties of his employment.

Other allowances.

6. The Chairman of the Commission and the Deputy Chairman of the Commission are entitled to be paid the allowances that would be payable to them under regulations 90 and 97 of the Public Service Regulations, as in force from time to time, if—

(a) they were officers of the Public Service;

(b) a reference in those regulations to the Chief Officer were read as a reference to the Chairman of the Commission or the Deputy Chairman of the Commission; and

(c) a reference in those regulations to the Public Service Board were read as a reference to the Minister.

Application.

7. These Regulations apply in respect of any period of office as a member of the Commission or a Committee on or after the ninth day of December, 1971.
