Application for approval of The Australian Unity Retirement Living “Consumer Directed Care Model” Enterprise Agreement 2013 - Greenfields agreement

[1] An application has been made for approval of an enterprise agreement known as The Australian Unity Retirement Living “Consumer Directed Care Model” Enterprise Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement says that the enterprise is a genuine new enterprise the employer is proposing to establish. It also states that the employer had not employed any of the persons who will be necessary for the normal conduct of the new business and who will be covered by the Agreement at the date the Agreement was made. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.

[3] I am satisfied that each of the requirements of ss.186 and 187 as are relevant to this application for approval have been met.

[4] I am also satisfied for the purposes of s.187(5) of the Act, that the employee organisation covered by the Agreement, is entitled to represent the industrial interests of a majority of the employees to be covered by the Agreement, and that it is in the public interest to approve the Agreement.

[5] The agreement does not contain the required consultation term. Pursuant to s.205 of the Act, the model consultation term prescribed by the Fair Work Regulations is taken to be a term of the Agreement.

[6] The Agreement is approved and, in accordance with s.54, will operate from 26 February 2014. The nominal expiry date of the Agreement is 9 January 2018.
