Australian Securities Commission Amendment Regulations 1998 (No. 1)2

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulations under the Australian Securities and Investments Commission Act 1989.

1.   Name of regulations

1.1   These regulations are the Australian Securities Commission Amendment Regulations 1998 (No. 1).

2.   Commencement

2.1   These regulations commence on gazettal.

3.   Amendment

3.1   The Australian Securities Commission Regulations are amended as set out in these regulations.

4.   Regulation 1 (Citation)

4.1   Omit the regulation, substitute:

Name of regulations

 “1. These regulations are the Australian Securities and Investments Commission Regulations 1990.”.

5.   Regulation 2 (Definitions)

5.1   Definition of the Act:

After “Securities”, insert “and Investments”.

6. Regulation 3 (Prescribed agency:

paragraph 18 (2) (d) of the Act)

6.1   Omit the regulation, substitute:

Prescribed agencies (Act, s 18 (2) (d))

 “3. For paragraph 18 (2) (d) of the Act, each of the following agencies is prescribed:

• (a)

  the Australian Competition and Consumer Commission;

• (b)

  the Australian Prudential Regulation Authority;

• (c)

  the Australian Taxation Office;

• (d)

  the Australian Transaction Reports and Analysis Centre;

• (e)

  an authority of a State or Territory having functions and powers similar to those of the Director of Public Prosecutions;

• (f)

  the police force or service of each State and the Northern Territory.”.

7.   Regulation 5 (Notice to produce books)

7.1   Omit “or section 33”, substitute “or section 32A or 33”.

8.1   Form 1 (heading):

Omit:
