Part 1—Preliminary

1        Name of legislative instrument

This is the ASIC Corporations (Amendment) Instrument 2018/483.

2        Commencement

This instrument commences on the day after it is registered on the Federal Register of Legislation.

This instrument is made under sections 741 and 1020F of the Corporations Act 2001.

4        Schedule

Each instrument that is specified in the Schedule to this instrument is amended as set out in the applicable items in the Schedule.

Schedule 1—Amendments

ASIC Corporations (Compromises or Arrangements) Instrument 2015/358

1        Section 4 (definition of foreign compromise or arrangement)

Omit the definition, substitute:

foreign compromise or arrangement means a compromise or arrangement that is:

(a)     between a foreign company and its members or any class of them; and

(b)     regulated by or under a law that is in force in or in a part of an eligible foreign country.

2        Subsection 5(3)

Omit “as the date”, substitute “as at the date”.
