Corporations Act 2001 – Subsection 741(1) – Variation

Enabling legislation

1. The Australian Securities and Investments Commission makes this instrument under subsection 741(1) of the Corporations Act 2001.

Title

2.       This instrument is ASIC Class Order [CO 10/94].

Commencement

3.       This instrument commences on the date it is registered under the Legislative Instruments Act 2003.

Note:   An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see Legislative Instruments Act 2003, s 4 (definition of register).  The FRLI may be accessed at ASIC Class Order [CO 00/195] is varied as follows:

(a)     in the heading omit “Corporations Law”, substitute “Corporations Act 2001”;

(b)     in the introductory words omit “Corporations Law (the “Law”)”, substitute “Corporations Act 2001 (the “Act”)”;

(c) omit “of the Law”, substitute “of the Act” (wherever occurring);

(d)     after paragraph 2, insert:

“For the avoidance of doubt, this instrument does not apply in relation to an offer of convertible securities of a body while a determination under subsection 713(6) of the Act is in force in relation to the body.”.
