Corporations Act 2001 — Subsection 601QA(1) — Variation

Enabling legislation

1. The Australian Securities and Investments Commission makes this instrument under subsection 601QA(1) of the Corporations Act 2001.

Title

2.         This instrument is ASIC Class Order [CO 09/462].

Commencement

3.         This instrument commences on the date it is registered under the Legislative Instruments Act 2003.

Note:       An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see Legislative Instruments Act 2003, s 4 (definition of register).  The FRLI may be accessed at ASIC Class Order [CO 05/26] is varied, in subparagraph 4(b), as follows:

(a)        omit subparagraph 601GAA(2)(c)(i), substitute:

“(i)       the issue, together with any related issue in the previous year does not, immediately before the issue, comprise more than 15% of the interests in that class; or”; and

(b)        in paragraph 601GAA(9)(a) omit “in subsubparagraph (2)(c)(i)(B) and paragraphs (3)(f),”, substitute “in paragraphs (3)(f),”.
