Corporations Act 2001 — Subsection 205G(6) — Variation

Enabling legislation

1.         The Australian Securities and Investments Commission (ASIC) makes this order under subsection 205G(6) of the Corporations Act 2001.

Title

2.         This order is ASIC Class Order [CO 08/382].

Commencement

3.         This order commences on the date it is registered under the Legislative Instruments Act 2003.

Note:       An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see Legislative Instruments Act 2003, s 4 (definition of register).  The FRLI may be accessed at ASIC Class Order [CO 01/1519] is varied as follows:

(a)    in Schedule A omit “Australian Stock Exchange Limited”, substitute “ASX Limited”; and

(b)    in paragraph 2 of Schedule C omit “through the ELF and the Company must comply with the technical and security features of the ELF set out in Schedule D and any other procedures issued by ASX from time to time to facilitate bodies using the ELF.”; substitute “through ASX Online in accordance with ASX Guidance Note 20—“ASX Online” issued on 5 May 2008.”; and

(c)    omit Schedule D; and

(d)    omit all the text under the heading “Interpretation”, substitute:

“In this order ASX Online means the electronic lodgment facility, which enables bodies included in the official list of ASX to transmit documents to ASX electronically, which is available at or such other address as may be notified by ASX from time to time.”.
