  1. Name of legislative instrument

This is the ASIC (Amendment) Instrument 2023/0470.

  1. Commencement

This instrument commences on the later of:

(a)1 July 2023; and

(b)the day after this instrument is registered on the Federal Register of Legislation.

  • This instrument is made under section 122A of the Australian Securities and Investments Commission Act 2001.

    1. Schedule

    Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

    Schedule 1—Amendments

    ASIC (Senior Staff Members—Determination) Instrument 2019/117

    1. Paragraph 5(d)

    Omit the paragraph, substitute:

    (d) without limiting anything in the paragraphs above and to avoid doubt:

    (i)    Chief of Staff;

    (ii)   Chief Financial Officer;

    (iii)    Chief Technology Officer;

    (iv)    Chief Risk Officer;

    (v)   Commission Counsel;

    (vi)    General Counsel;

    (vii)  Special Counsel.

    1. Subsection 6(3)

    Omit the subsection (including the heading), substitute:

    Senior staff members for employment purposes

    (3)A staff member who holds or acts in any of the following positions is a senior staff member for the purposes of performing functions and exercising powers in relation to the employment of staff (including the terms and conditions of employment) under section 120 of the ASIC Act:

    (a)     Head, People and Development;

    (b)     Senior Manager, People and Development.
