REGULATIONS UNDER THE NAVAL DEFENCE ACT
1910-1952.*
I, THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the Naval Defence Act 1910-1952.

AUSTRALIAN SEA CADET CORPS REGULATIONS.
Part I.—Preliminary.
Citation.
1. These Regulations may be cited as the Australian Sea
Cadet Corps Regulations.
Parts.

Definitions.
3. In these Regulations, unless the contrary intention
appears—
“cadet” means a cadet of the Corps and includes a Cadet Sub-Lieutenant;
“instructor” means a Chief Petty Officer Instructor or Petty Officer
Instructor;
“member” means an officer, instructor or cadet of the Corps;
“officer” means an officer of the Corps,
but does not include an instructor;

“the
Corps” means the Australian Sea Cadet Corps, being the body of cadets raised
under that name by the Navy League together with officers and instructors
appointed under these Regulations;
“the
Director” means the officer appointed by the Naval Board to be Director of
Naval Reserves or the person for the time being performing the duties of the
Director;
“the Naval
Board” means the Naval Board of Administration constituted under the Naval
Defence Act 1910-1952;
“the Navy
League” means the Navy League of Australia;
“unit”
means a group of members formed in an area.
Operation of Regulations.
4. These Regulations apply only while there are in
operation arrangements made by the Naval Board, in association with the Navy
League of Australia, for the instruction and equipment of cadets.
Part II.—Organization.
Responsibility of Director.
5. The Director is responsible to the Naval Board for
the administration of all matters arising out of these Regulations and the
arrangements made by the Naval Board in relation to the Corps, except financial
matters and store accounting.
Sea Cadet Council.
6. The Naval Board may approve the formation of a Sea
Cadet Council consisting of officers of the Naval Forces and representatives of
the Navy League to advise the Naval Board on matters relating to the
administration of these Regulations and the arrangements made by the Naval
Board in relation to the Corps.
Formation of units.
7.—(1.) The Navy League may, with the approval of the
Naval Board, form units of the Corps.
(2.) The composition and strength of units shall be as approved by the
Naval Board.
(3.) No financial or other assistance under these Regulations shall be
provided to a unit or a member of a unit until the unit has been inspected by
or on behalf of the Director and recognized by the Naval Board.
Withdrawal of recognition.
8.— (1.) The Naval Board may, at any time, withdraw
recognition of a unit and order the return of stores or other property of the
Commonwealth issued for the use of the unit.
(2.) Upon recognition being withdrawn—
(a)
financial or other assistance under these Regulations shall not be provided to
or in respect of the unit;
(b)
the appointments of all officers and instructors of the unit shall be deemed to
be terminated; and
(c)
no member of the unit is entitled to wear the uniform of the Corps authorized
under these Regulations, unless he has become a member of another unit that is
recognized by the Naval Board.
Inspection of units.
9. The Director or an officer of the Naval Forces
authorized by him shall inspect each unit at least once in each year in order
to determine the efficiency of the unit and to ascertain whether the
instructions, issued by the Naval Board are being observed.
Part III.—Cadets, Officers and Instructors.
Nationality.
10. Members shall be British subjects and substantially
of European descent.
Age of cadets.
11. Youths who will attain the age of fourteen years
before the first day of January next following the date of their application
for enrolment, and youths who have attained the age of fourteen years but have
not attained the age of eighteen years, may be enrolled as cadets in the Corps.
Appointment of officers and
instructors.
12.—(1.) The Director may appoint as officers or
instructors of the Corps persons who hold such certificates or possess such
qualifications as he considers adequate.
(2.) The
ranks and ratings to which officers and instructors may be appointed are—
Sea Cadet
Commander;
Sea Cadet
Lieutenant-Commander;
Sea Cadet
Lieutenant;
Sea Cadet
Sub-Lieutenant;
Cadet
Sub-Lieutenant;
Chief
Petty Officer Instructor;
Petty Officer Instructor.
(3.) The Director may appoint an officer to an acting rank.
(4.) The conditions of appointment of officers and instructors shall be
as approved by the Naval Board.
(5.) Officers and instructors hold rank or rating, precedence and
command only within the Corps.
(6.) There is no age limit for the appointment or retirement of officers
and instructors.
(7.) Officers shall supervise and take part in the instruction of
cadets.
Resignation.
13. A member may resign at any time.
Termination and discharge.
14.—(1.) The Director may terminate the appointment of an
officer or instructor on any of the following grounds:—
(a) that the officer or instructor has
ceased to perform his duties;
(b) misconduct;
(c) inefficiency;
(d) unsuitability;
(e) unsatisfactory attendance; and
(f) medical unfitness.
(2.) The Director may order the discharge of a cadet on any of the
following grounds:—
(a) misconduct;
(b) inefficiency;
(c) unsuitability;
(d) unsatisfactory attendance;
(e) medical unfitness; and
(f) attainment of the age of nineteen
years.
Promotion and advancement.
15. The manner of, and qualifications for, promotion of
officers and advancement of instructors and cadets are as approved by the Naval
Board.
Part IV.—Training.
Training.
16.—(1.) Units shall undergo training as determined by the Director.
(2.) The Director may determine the minimum attendances required of
officers, instructors and cadets.
Efficiency.
17.—(1.) In order to be classified as “efficient” in
respect of any year a cadet shall satisfy the Director, or an officer of the
Naval Forces authorized by the Director, that he has in that year—
(a) attended home training drills or
parades for periods totalling not less than sixty hours;
(b) attended continuous training of not
less than seven days’ duration at a camp or otherwise;
(c) completed a course of musketry on a
miniature firing range;
and
(d)
attained the standard of proficiency which he could reasonably be expected to
have attained.
(2.) The
requirement specified in paragraph (b) or (c) of the last
preceding sub-regulation may be waived if facilities for complying with the
requirement have not been available.
Part V.—Uniform.
Provision
of uniform.
18.—(1.) Members shall be supplied at the expense of the
Commonwealth with such articles of uniform as are approved by the Naval Board.
(2.) Articles of uniform so supplied are to remain the property of the
Commonwealth.
(3.) Members whose appointments are terminated or who are discharged
shall deliver to an instructor or officer of the Corps all articles of uniform
and accoutrements issued to him which are the property of the Commonwealth.
(4.) Items of uniform may, in special circumstances, be issued on
repayment upon the signed authority of the Director.
Uniform of officers and
instructors.
19. The uniform of officers and instructors shall be of a
pattern similar to that prescribed for officers, chief petty officers and petty
officers of the Royal Australian Naval Reserve, with the exception of cap
badges, buttons, distinguishing stripes and other badges which shall be as
approved by the Naval Board.
Uniform of cadets.
20. The uniform of cadets shall be of a pattern similar
to that prescribed for cadets of the Royal Australian Naval Reserve, with the
exception of cap ribbons and other distinguishing badges which shall be
approved by the Naval Board.
Wearing of uniform.
21.—(1.) A member when attending instruction, or on other
occasions as permitted by the Naval Board, is to appear in the proper dress of
the day.
(2.) Except as provided in the last preceding sub-regulation or when a
member is proceeding to and from drills and training, the wearing of uniform is
prohibited.
Responsibility for care of
uniform.
22.—(1.) A member is responsible for the proper care and
preservation of his uniform.
(2.) Damage or deterioration not due to fair wear and tear shall be made
good at the expense of the member concerned.
Alteration to uniform on
promotion.
23. On promotion to higher rank, an officer may be
reimbursed the cost of necessary alterations to uniform, on production of
receipted vouchers and within the limits of amounts approved by the Naval
Board.
Uniform of members of Citizen
Naval Forces.
24.—(1.) Officers and men of the Citizen Naval Forces
carrying out duties with the Corps may be issued with items of uniform
appropriate to their rank or rating on a scale not exceeding that approved by
the Naval Board for officers and instructors.
(2.) The issue of uniform under this regulation is in substitution for
and not in addition to that prescribed under the regulations relating to the
Citizen Naval Forces.
(3.) Issues made under this regulation shall be taken into consideration
when the uniform of officers and men of the Citizen Naval Forces is being
brought up to the approved war-time outfit.
Uniform, bedding and
equipment.
25. Members may be supplied on loan with uniform, bedding
and equipment necessary for the purpose of continuous training or courses.
Part VI.—Victualling
and Messing.
Victualling during continuous
training.
26. During continuous training or courses in Her
Majesty’s Australian ships or Naval establishments exceeding twenty-four hours,
members shall be victualled at the expense of the Commonwealth in accordance
with the conditions applicable to the Permanent Naval Forces.
Issue on loan of mess traps.
27. The issue of mess traps on loan during periods of
continuous training or courses may be approved by the Director.
Part VII.—Stores.
Issue of and accounting for
stores.
28.—(1.) Stores or other property of the Commonwealth
both permanent and consumable may be issued to units for the purpose of
carrying out training.
(2.) The conditions of issue and the accounting arrangements shall be as
approved by the Naval Board.
Part VIII.—Financial.
Financial records to be
maintained.
29. While any financial assistance is being provided
under these Regulations, the Navy League, including State Divisions of the
League, and units of the Corps, shall maintain financial records as ordered by
the Naval Board.
Efficiency allowance.
30.—(1.) There may be paid to the Navy League in respect
of each financial year a monetary grant, to be known as an efficiency
allowance, at the rate of Five shillings for each cadet, other than a Cadet
Sub-Lieutenant, who—
(a)
is on the authorized establishment of a unit of the Corps on
the last day of that year;
(b) has been a member for the whole of
that year; and
(c) has been classified as “efficient” in
respect of that year.
(2.) The efficiency allowance may also be paid pro rata for each
cadet, other than a Cadet Sub-Lieutenant, classified as “efficient” belonging
to a unit formed during the year, but the amount so paid shall not exceed
three-quarters of the amount that would have been payable in respect of a
complete year.
(3.) At the discretion of the Naval Board, the efficiency allowance in
respect of any financial year may be reduced by any portion of the balance of
the allowance paid in respect of the previous year which has not been expended
in accordance with the next succeeding sub-regulation.
(4.) The efficiency allowance shall be expended only for the care and
preservation of arms and instructional equipment, postage and stationery,
payment for losses or damage to property of the Commonwealth and such other
services for the benefit of the Corps as are approved by the Naval Board.
Annual special allowance.
31.—(1.) The Director may authorize the payment of an
annual special allowance at the rates set out in the following table to
officers and instructors for attendances of not less than sixty hours at home
training drills or parades in respect of which there is no pay under the next
succeeding regulation where the officer or instructor has performed his duties
efficiently during the whole of a financial year:—

(2.)
Subject to regulation 34 of these Regulations, the Director may authorize
payment of the annual special allowances at an appropriate rate to an officer
or man of the Citizen Naval Forces who has performed instructional duties with
the Corps.
(3.) Where an officer or instructor has served during part only of a
financial year or where his total attendances for the year are less than sixty
hours, he may be paid pro rata for each completed month of service
during which he has attended not less than half the drills or parades held.
Officers’ and instructors’
pay for continuous training.
32.—(1.) The Director may authorize payment at the rates
set out in sub-regulation (3.) of this regulation to officers (excepting Cadet
Sub-Lieutenants) and instructors in respect of service throughout authorized
periods of continuous training camps and courses of not less than seven days’
duration.
(2.) An officer or instructor shall not be paid in respect of so much of
a period of training as exceeds twelve days unless the Naval Board for special
reasons otherwise approves.
(3.) The rates of pay are as follows:—

(4.)
Subject to regulation 34 of these Regulations, the Director may authorize
payment at appropriate “on promotion” rates of pay to officers and men of the
Citizen Naval Forces undertaking instructional duties in the Corps.
(5.) Where an officer or instructor is unable to attend for the full
period of a continuous training camp or course, he may, with the approval of
the Naval Board, be paid for the number of days attended.
Marriage allowance.
33.—(1.) In addition to pay at the rates set out in the
last preceding regulation, marriage allowance (but not separation allowance)
may be paid to a married officer or instructor at the rate and under the
conditions prescribed for a member of the Citizen Naval Forces.
(2.) No allotment is required.
(3.) Where a married officer or instructor does not attend for the full
period of a continuous training camp or course, he may be paid marriage
allowance for the period for which he receives pay under sub-regulation (5.) of
the last preceding regulation.
(4.) Marriage allowance may also be paid to officers and men of the
Citizen Naval Forces entitled to pay under sub-regulation (4.) of the last
preceding regulation.
Limit on payment to member of
Citizen Naval Forces.
34. The total amount of pay and allowances paid in
respect of a financial year to a member of the Citizen Naval Forces who is
carrying out training as a member of a Naval Reserve Force as well as being
engaged in the instruction of Sea Cadets shall not exceed the pay and
allowances payable under the Naval Reserve Regulations for the approved period
of training for the year.
Messing allowance to Sea Cadet
Sub-Lieutenant.
35. For attendances at continuous training camps or
courses of not less than seven days’ duration a Sea Cadet Sub-Lieutenant may be
paid a supplementary allowance at the rate of Three shillings per day in
respect of messing.
Payment of fares, &c.
36. Payment of fares may be made, travelling warrants may
be issued, or transport provided at Commonwealth expense when travel by members
is necessary to or from places at which continuous training camps or courses in
Her Majesty’s Australian ships or Naval establishments exceeding twenty-four
hours are held.
Part X.—Medical.
Medical attention.
37.—Medical attention may be provided for members during
periods of training camps or courses in Her Majesty’s Australian ships or Naval
establishments.
