1  Name

This instrument is the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) (Modifications of the Repatriation Private Patient Principles) Instrument 2017.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under section 17 of the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006.

  1. Schedule 1—Modifications of the Repatriation Private Patient Principles

The Repatriation Private Patient Principles are modified as set out in Schedule 1 to this instrument for the purposes of the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006.

  1. Schedule 2—Repeals

Each instrument that is specified in Schedule 2 to this instrument is repealed as set out in the applicable item in that Schedule, and any other item in that Schedule has effect according to its terms.

Schedule 1—Modifications of the Repatriation Private Patient Principles

Repatriation Private Patient Principles

1  Paragraphs 1.1 and 1.1A

Omit the paragraphs, substitute:

1.1  Name

This instrument is the Principles.

1.1A  Commencement

The Principles commence on 1 July 2017.

1.1B  Transitional provision

  If:

(a)  a thing was started under the Veterans’ Affairs (Modified Repatriation Private Patient Principles ‑ Australian Participants in British Nuclear Tests) Instrument 2006 before 1 July 2017; and

(b)  immediately before that day, the thing has not been finished;

then, the thing may be finished under these Principles on or after that day as if it had been started under these Principles.

2  Paragraph 1.2 (definition of Act)

Omit the definition, substitute:

Act means the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006.

3  Paragraph 1.2 (definition of Commission)

Omit the definition, substitute:

Commission has the meaning given by section 5A of the Veterans’ Entitlements Act 1986.

4  Paragraph 1.2 (definition of dependent of a Vietnam veteran)

Omit the definition.

5  Paragraph 1.2 (definition of entitled person)

Omit the definition, substitute:

entitled person means an eligible person within the meaning of the Act.

6  Paragraph 1.2 (definition of former Repatriation Hospital)

Omit the definition, substitute:

former Repatriation Hospital means a hospital or other institution that was formerly operated by the Commission under paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986.

7  Paragraph 1.2 (definition of Principles)

Omit the definition, substitute:

Principles means the Repatriation Private Patient Principles as modified by the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) (Modifications of the Repatriation Private Patient Principles) Instrument 2017.

8  Paragraph 1.2 (definition of private patient)

Omit the definition, substitute:

private patient has a meaning affected by subsection 17(8) of the Act.

9  Paragraph 1.2 (definition of Treatment Principles)

Omit the definition, substitute:

Treatment Principles means the Treatment Principles as modified by the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) (Modifications of the Treatment Principles) Instrument 2013.

10  Paragraph 1.2 (definition of veteran partnering private hospital)

Omit “the Act”, substitute “the Veterans’ Entitlements Act 1986”.

11  Paragraph 1.2 (definition of Vietnam veteran)

Omit the definition.

12  Paragraph 3.6

Omit the paragraph.

Schedule 2—Repeals
