Alteration of other rules of organisation.

[1]        On 6 February 2015, the Australian Nursing and Midwifery Federation (the ANMF)

lodged with the Fair Work Commission (the Commission) a notice and declaration setting

out particulars of alterations to the rules of the ANMF.

[2]        The particulars set out alterations to rules 8.4, 8.5, 8.6 and 10.2.1 of the rules of the

ANMF.
[3]	On 13 February 2015, the Commission wrote to the ANMF requesting the filing of

further evidence demonstrating that the quorum requirements set out in rule 20.1 of the rules

of the ANMF were met during the relevant voting process of the members of Federal Council

which was undertaken in accordance with rule 18.7 of the rules of the ANMF.

[4]        On the same date, the ANMF filed further documentation which indicates that the

quorum requirements set out in rule 20.1 were fulfilled.

[5]        On the information contained in the notice and the further documentation filed on 13

February 2015, I am satisfied the alterations have been made under the rules of the

organisation.

[6]        On 17 February 2015, the ANMF gave consent, under subsection 159(2) of the Fair

Work (Registered Organisations) Act 2009, for the Delegate to make various amendments to

the alterations for the purpose of correcting typographical, clerical or formal errors.

Accordingly the following corrections have been made:

 In proposed rule 8.6, the words “upon being” as they appear immediately after the

words “shall not be” and before the words “admitted to membership” have been

omitted and the references to “Sub Rule 8.9” and “Sub Rule 8.10” have been omitted

and replaced with references to “Sub Rule 8.7” and “Sub Rule 8.8” respectively.

[7]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
