Australian Museum Trust Regulation 1998 (NSW)
His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Australian Museum Trust Act 1975.
Minister for the Arts
This Regulation is the Australian Museum Trust Regulation 1998.
This Regulation commences on 1 September 1998.
In this Regulation:
(a) a trustee or a member of staff, or
(b) a person who is on the premises in connection with the provision of goods or services.
The explanatory note and table of contents do not form part of this Regulation.
The Trust may from time to time determine:
(a) the fees payable for admission to the Museum or any part of the Museum, and
(b) the fees payable for the photographing of exhibits for commercial purposes.
Fees may differ according to such factors as the Trust may determine.
The Trust may exempt any person or class of persons from paying any fee.
The Museum is to be open to the public, on such days and at such times as the Trust may from time to time determine, on payment of the relevant admission fee.
No admission fees are payable by visitors who are exempted by the Trust from payment of admission fees or who belong to a class of visitors so exempted.
A visitor must not photograph any exhibit otherwise than:
(a) with the permission of the Director or of a member of staff authorised by the Director to give such permission, and
(b) if the photograph is taken for commercial purposes, on payment of the relevant fee for photographing the exhibit.
Maximum penalty: 2 penalty units.
Subclause (1) (b) does not apply if the visitor is exempted by the Trust from payment of the fee or belongs to a class of visitors so exempted.
Ordinary meetings of the Trust are to be held, at least 4 times in each year, at such times as are determined by the Trust.
Special meetings of the Trust may be called by the Director at the written request of:
(a) the President and any 2 trustees, or
(b) a majority of the trustees.
Such a request must set out the purpose of the proposed meeting.
At a special meeting, the only business that may be transacted is that specified in the notice of the meeting.
The Director is to give each trustee at least 48 hours’ written notice of the day, hour and place of, and of the business to be considered at, each meeting.
If a quorum of a meeting is not present within 15 minutes of the time specified in the notice calling the meeting:
(a) the meeting is to be adjourned to a day to be specified by the trustees then present, and
(b) if a quorum of the Trust Committee is present, the business of the meeting is to be referred to that Committee for its consideration and report to the adjourned meeting.
In this clause,
The President is entitled to attend any committee established by the Trust and to be heard on any matter being considered by the committee.
The Australian Museum Trust Regulation 1993 is repealed.
Any act, matter or thing that, immediately before the commencement of this Regulation, had effect under the Australian Museum Trust Regulation 1993 continues to have effect under this Regulation.
