AUSTRALIAN MUSEUM TRUST ACT 1975—REGULATION

(Australian Museum Trust Regulation 1993)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Australian Museum Trust Act 1975, has been pleased to make the Regulation set forth hereunder.

PART 1—PRELIMINARY

Citation

1. This Regulation may be cited as the Australian Museum Trust

Regulation 1993.

Commencement

2. This Regulation commences on 1 September 1993.

Definitions

3. In this Regulation:
“Director” means the Director of the Museum;
“meeting” means a meeting of the Trust;
“member of staff” means a member of staff of the Museum;

“Museum” means the Australian Museum, and includes any branch

or department of the Museum;

“President” means the President of the Australian Museum Trust;
“the Act” means the Australian Museum Trust Act 1975;

“visitor” means a person who is on the premises of the Museum, but

does not include:

(a) a trustee or a member of staff; or

(b) a tradesman or other person who is on the premises in connection with the provision of goods or services.

PART 2—VISITORS TO THE MUSEUM

Fees

4. (1) The Trust may from time to time determine:

(a)

the fees payable for admission to the Museum or any part of the Museum; and

(b)

the fees payable for the photographing of exhibits for commercial purposes.

(2) Fees may differ according to such factors as the Trust may

determine.

(3) The Trust may exempt any person or class of persons from paying

any fee.

Admission to the Museum

5. (1) The Museum is to be open to the public on such days and at

such times as the Trust may from time to time determine.

(2) A visitor must not enter the Museum or any part of the Museum

except on payment of the relevant admission fee.

Maximum penalty: 2 penalty units.

(3) Subclause (2) does not apply if the visitor is exempted by the Trust

from payment of the fee or belongs to a class of visitors so exempted.

Closed sections

6. (1) The Trust may, by means of notices or barriers, exclude the

public from any part of the Museum.

(2) A visitor must not enter any part of the Museum in wilful contravention of any such notice, or in wilful disregard of any such barrier, unless authorised to do so by the Trust or by the Director.

Maximum penalty: 2 penalty units.

Baggage

7. (1) A visitor must not bring into the Museum any umbrella, parcel,

suitcase, item of sporting equipment or other like article.

Maximum penalty: 2 penalty units.

(2) This clause does not prevent a visitor from depositing an umbrella,

parcel, suitcase, item of sporting equipment or other like article with the

attendant at the main door of the Museum.

Offensive behaviour

8. (1) Any member of staff may direct a visitor to leave the Museum:

(a) if the visitor is behaving in an offensive manner; or

(b) if, in the opinion of the member of staff, the visitor’s condition is likely to interfere with any other visitor’s reasonable use or enjoyment of the Museum; or

(c) if the visitor is contravening any provision of this Regulation. (2) A visitor must not fail to leave the Museum if so directed by a

member of staff.

Maximum penalty: 2 penalty units.

Handling exhibits

9. A visitor must not handle any exhibit otherwise than with the

permission of the Director or of a member of staff authorised by the

Director to give such permission.

Maximum penalty: 2 penalty units.

Photographing exhibits

10. (1) A visitor must not photograph any exhibit otherwise than:

(a)

with the permission of the Director or of a member of staff authorised by the Director to give such permission; and

(b)

if the photograph is taken for commercial purposes, on payment of the relevant fee for photographing the exhibit.

Maximum penalty: 2 penalty units.
(2) Subclause (1) (b) does not apply if the visitor is exempted by the

Trust from payment of the fee or belongs to a class of visitors so exempted .

PART 3—PROCEEDINGS OF THE TRUST

Ordinary meetings

11. Ordinary meetings of the Trust are to be held, at least 4 times in

each year, at such times as are determined by the Trust.

Special meetings

12. (1) Special meetings of the Trust may be called by the Director at

the written request of:

(a) the President and any 2 trustees; or
(b) a majority of the trustees.

(2) Such a request must set out the purpose of the proposed meeting. (3) At a special meeting, the only business that may be transacted is

that specified in the notice of the meeting.

Notice of meetings

13. The Director is to give each trustee at least 48 hours’ written

notice of the day, hour and place of, and of the business to be considered

at, each meeting.

Adjourned meetings

14. (1) If a quorum of a meeting is not present within 15 minutes of

the time specified in the notice calling the meeting:

(a)

the meeting is to be adjourned to a day to be specified by the trustees then present; and

(b)

if a quorum of the General Standing Committee is present, the business of the meeting is to be referred to that Committee for its consideration and report to the adjourned meeting.

(2) In this clause:

‘‘General Standing Committee” means the General Standing

Committee established under section 8 (7) of the Act.

Committees

15. The President is entitled to attend any committee established by

the Trust and to be heard on any matter being considered by the
committee.

PART 4—GENERAL

Repeal

16. (1) The Australian Museum Trust Regulation 1977 is repealed. (2) Any act, matter or thing that, immediately before the

commencement of this Regulation, had effect under the Australian Museum Trust Regulation 1977 is taken to have effect under this Regulation.

EXPLANATORY NOTE

The purpose of this Regulation is to repeal and replace the Australian Museum

Trust Regulation 1977. The new Regulation deals with the following matters:

(a)

the regulation of the admission of visitors to the Museum and the behaviour of visitors (Part 2); and

(b)

the proceedings of the Australian Museum Trust and committees appointed by the Trust (Part 3); and

(c) other minor, consequential and ancillary matters (Parts 1 and 4).

This Regulation is made under the Australian Museum Trust Act 1975, including

section 19 (the general regulation making power).

This Regulation is made in connection with the staged repeal of subordinate

legislation under the Subordinate Legislation Act 1989.
