Alteration of other rules of organisation.

[1] On 9 December 2014 the Australian Municipal, Administrative, Clerical and Services Union (the Union) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to New South Wales and ACT (Services) Branch Rules (the Branch Rules) the rules of the Union.

[2]        The particulars set out alterations to rules 10, 13, 25, 26 and 28 of the Branch Rules of

the Union.

[3] The alterations amend rule 10 to accommodate the existing Industry Division structure; insert a new sub rule 13(b) which provides a formula for calculating the number of votes assigned to Branch Councillors; delete sub rule 25(a) in order to remove references to the superseded Industry Division Structure; amend sub rule 25(b) to remove references to an historical transitional date for the existing Industry Division structure; amend sub rules 26(a) and 26(b) and delete sub rules 26(c), 26(e) and 26(g) so as to remove references to the now- defunct Industry Divisions: Water; Ports; Information Technology; and Airlines, Shipping and Travel; and provide for the composition of the Committees of Management for the existing Water and Ports; and Social and Community Services Industry Divisions; insert new sub rule 26(e) which provides for the composition of the Committee of Management for the existing Airlines, Shipping, Travel and IT Industry Division; renumber 26(d), 26(f) and 26(h) as a consequences of the earlier amendments; insert the word “ordinarily” in rule 28 in relation to the holding of Industry Division meetings at least once every three months; and provide for other consequential amendments and renumbering of sub rules.

[4] On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.

[5] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
