Alteration of other rules of organisation.

  1. On 14 December 2018 the Australian Municipal, Administrative, Clerical and Services Union (the Union) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.

  1. The particulars set out alterations to Division Three, Queensland (Services and Northern Administrative) Branch Rules:

    7 – Branch Executive
    18 – Branch Council Membership
    33 – Election of Branch Office/Position Holders

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. Each alteration seeks to remedy minor inconsistencies which impact the conduct of elections in the Branch.

  1. The alteration to Rule 7 rephrases the number of Branch Industry Division Vice-President positions to ensure consistency with the formula set out in Rule 44.

  1. The alteration to Rule 18 removes table headings that confuse the formula for calculating the number of available Branch Council positions.

  1. The alterations to Rule 33 correct an error so that National Conference Delegates are elected by an electoral college system as is specified in Rule 23.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
