REGULATIONS UNDER THE DEFENCE ACT 1903-1975.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1975.

Amendments of the Australian Military Regulations 

Commencement.

1. These Regulations shall come into operation on 9 February 1976.

2. After regulation 20 of the Australian Military Regulations the following regulation is inserted in Part II:—

Order of Battle, establishments, &c.

“21. (1) For the purposes of section 33 of the Act, the Chief of the General Staff may, subject to any directions of the Minister, determine—

(a) the Order of Battle for the Army;

(b) establishments for the Army; and

(c) the ranks for positions on those establishments.

“(2) In making a determination under sub-regulation (1) in relation to the ranks for the positions on establishments, the Chief of the General Staff may specify that a position shall ordinarily be occupied by a member included in a class of members specified in the determination.”.

Offences by persons subject to military law.

3. Regulation 203 of the Australian Military Regulations is amended by adding at the end thereof the following sub-regulation:—

“(5) For the purposes of this regulation, a person shall be taken to be drunk if, and only if, his faculties are, by reason of his being under the influence of intoxicating liquor or of a drug, so impaired that—

(a) it would be imprudent to allow him to discharge, or to continue to discharge, his duties; or

(b) he is unfit to discharge his duties.”.

4. Regulation 342 of the Australian Military Regulations is amended by adding at the end thereof the following sub-regulation:—

“(5) In this regulation, ‘the prescribed authority’ means—

(a) the authority confirming the finding of a court-martial;

(b) the Chief of the General Staff; or

(c) an officer authorized by the Chief of the General Staff.”.

Appointment and duties of Judge-Advocate-General and Deputies.

5. Regulation 575 of the Australian Military Regulations is amended by inserting after sub-regulation (6) the following sub-regulation:—

“(6a) A delegation under sub-regulation (6) is revocable at will and does not prevent the exercise of a power or the performance of a function by the Judge-Advocate-General or by the Deputy-Judge-Advocate-General, as the case may be.”.

“748. In this Division—

‘service tribunal’ means a court-martial and includes an officer exercising jurisdiction summarily in respect of offences committed by members;

‘record’ means all documents, photographic representations, tapes or other things of whatsoever description used to record any entry, minute, certificate, letter or information relating to or concerning a member.

“749. (1) A regimental conduct sheet shall be kept in respect of every member.

“(2) The entries to be made in the regimental conduct sheet of a member shall be—

(a) every conviction and sentence imposed by a service tribunal;

(b) every remission, commutation or mitigation of a sentence imposed by a service tribunal;

(c) every conviction by a civil court; and

(d) every act of gallantry or distinguished conduct which has been brought to notice in orders or despatches.

“(3) No entry shall be made of any charge of which a member was found not guilty by a service tribunal or civil court.

“(4) Where a civil court finds the offence proved but dismisses the charge or where a civil court, without proceeding to conviction, binds over the member to be of good behaviour, no entry shall be made in the regimental conduct sheet of a member.

“750. Such other records, in addition to the regimental conduct sheet, relating to members shall be kept, organized and maintained in such manner as the Chief of Personnel directs.

“751. A copy of a regimental conduct sheet certified to be a true copy by the person having custody of the original shall on production in any proceedings before a service tribunal, be evidence of the facts recorded in it without proof of the handwriting of the person or of his having such custody.”.
