REGULATIONS UNDER THE DEFENCE ACT 1903-1956.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1956.

Amendments of the Australian Military Regulations. 

Subdivision of Regulations.

1. Regulation 2 of the Australian Military Regulations is amended by omitting the words and figures—

“Division 3.—Royal Australian Army Medical Corps 543A-550

Division 3a.—Royal Australian Army Dental Corps 550a-550g”

and inserting in their stead the words and figures—

“Division 3.—Royal Australian Army Medical Corps 544-554

Division 4.—Royal Australian Army Dental Corps 555-563”

Committees.

2. Regulation 33 of the Australian Military Regulations is repealed.

Repeal.

3. Regulations 54 and 54a of the Australian Military Regulations are repealed.

Prescribed corps for the purposes of section 21a.

4. Regulation 81a of the Australian Military Regulations is amended by inserting after paragraph (d)the following paragraph:—

“(da)The Australian Army Printing and Stationery Service;”.

Service before promotion of officers in the Permanent Forces.

5. Regulation 85 of the Australian Military Regulations is amended—

(a) by omitting from sub-paragraph (ii) of paragraph (a) of sub-regulation (1.) the words “eight years” and inserting in their stead the words “ seven and one half years”;

(b) by omitting from sub-paragraph (iii) of paragraph (a)of sub-regulation (1.) the words “fourteen years” and inserting in their stead the words “ thirteen and one half years”;

(c) by omitting from sub-paragraph (i) of paragraph (b)of sub-regulation (1.) the words “three and a half years” and inserting in their stead the words “ three years”;

(d)by omitting from sub-paragraph (ii) of paragraph (b) of sub-regulation (1.) the words “seven and a half years” and inserting in their stead the words “seven years”;

(e) by omitting from sub-paragraph (iii) of paragraph (b)of sub-regulation (1.) the words “thirteen and a half years” and inserting in their stead the words “thirteen years”; and

(f) by omitting paragraphs (a) and (b) of sub-regulation (2.).

Transfer and appointment to Reserve of Officers.

6.Regulation 120 of the Australian Military Regulations is amended—

(a) by omitting from paragraph (b)of sub-regulation (2.) the words “the Royal Australian Army Medical Corps, the Royal Australian Army Dental Corps,”; and

(b) by omitting from paragraph (b)of sub-regulation (2.) the word “or” (last occurring) ; and

(c) by inserting in sub-regulation (2.), after paragraph (b), the following paragraphs:—

“(ba)is qualified for appointment, in accordance with Division 3 of Part VII., as an officer of the Active Forces in the Royal Australian Army Medical Corps;

(bb)is qualified for appointment, in accordance with Division 4 of Part VIL, as an officer of the Active Forces in the Royal Australian Army Dental Corps; or “.

Age for compulsory retirement, &c.

7. Regulation 191 of the Australian Military Regulations is amended by omitting sub-paragraphs (ii) and (iii) of paragraph (b)of sub-regulation (1.) and inserting in their stead the following sub-paragraphs:—

“(ii) if the soldier is a male soldier of the Citizen Forces who is a bandmaster, drum-major or bandsman—fifty-five years;

(iii) if the soldier is a male soldier of the Citizen Forces other than a bandmaster, drum-major or bandsman—forty-eight years; or

(iv) if the soldier is a female soldier of the Permanent Forces or the Citizen Forces—fifty years.”.

8. Divisions 3 and 3a of Part VII. of the Australian Military Regulations are repealed and the following Divisions inserted in their stead:—

“Division 3.—Royal Australian Army Medical Corps.

Constitution of Corps.

“544. The Royal Australian Army Medical Corps shall consist of officers and soldiers who—

(a) are appointed to, or enlisted in, that Corps; or

(b)are transferred to, or seconded for duty with, that Corps from other parts of the Military Forces.

Prescribed corps for the purposes of section 11a of the Act.

“545. The Royal Australian Army Medical Corps is a prescribed corps for the purposes of section 11a of the Act.

Appointment in accordance with this Division.

“546.—(1.) Subject to this Division, a person shall not be appointed as an officer in the Royal Australian Army Medical Corps unless he is qualified for appointment as an officer of the Active Forces or the Regular Army Special Reserve in that corps in accordance with this Division.

 

“(2.) A person who is qualified for appointment in the Royal Australian Army Medical Corps only as an officer of the Regular Army Special Reserve shall not be appointed in that Corps other than as an officer of the Regular Army Special Reserve.

“(3.) Subject to this Division, an officer shall not be transferred to, or seconded for duty with, the Royal Australian Army Medical Corps unless he is qualified for appointment as an officer of the Active Forces in that Corps in accordance with this Division.

Appointment of registered medical practitioners, &c.

“547.—(1.) A person is qualified for appointment as an officer of the Active Forces in the Royal Australian Army Medical Corps if he is registered or licensed, or qualified to be registered or licensed, under a law of a State or Territory that provides for the registration or licensing of medical practitioners.

“(2.) Where a person who—

(a) was appointed as an officer of the Australian Regular Army in the Royal Australian Army Medical Corps to the substantive rank of captain; and

(b)had, on appointment, the qualifications specified in sub-regulation (1.) of this regulation,

qualifies for promotion to the substantive rank of major, he may, notwithstanding regulation 85 of these Regulations, be promoted to the substantive rank of major after four years’ service in the rank of captain.

Appointment of undergraduates, &c.

“548.—(1.) Subject to such conditions as arc approved by the Military Board, a person is qualified for appointment as an officer of the Regular Army Special Reserve in the Royal Australian Army Medical Corps if he is the holder of, or qualified for admission to, a degree in medicine of, or is an undergraduate in the faculty of medicine at, a university in a State or Territory.

“(2.) Notwithstanding regulation 85 of these Regulations, the promotion of a person who—

(a) is appointed as an officer of the Regular Army Special Reserve in the Royal Australian Army Medical Corps; and

(b)has, on appointment, the qualifications specified in sub-regulation (1.) of this regulation,

is subject to such conditions as are approved by the Military Board.

Appointment of pharmaceutical chemists.

“549. A person is qualified for appointment as an officer of the Active Forces in the Royal Australian Army Medical Corps if he is registered as a pharmaceutical chemist under a law of a State or Territory that provides for the registration of pharmaceutical chemists.

Appointment of person to fill vacancy.

“550. Notwithstanding regulation 546 of these Regulation, a person who is not qualified for appointment as an officer of the Active Forces or the Regular Army Special Reserve in the Royal Australian Army Medical Corps in accordance with this Division but whose services are required to fill a vacancy on the authorized establishment of—

(a) a medical unit of the Military Forces;

(b)a unit of the Military Forces raised to assist in maintaining the health of members of the Military Forces; or

(c)the medical services at a headquarters of the Military Forces,

may be appointed as an officer in, or, being an officer, may be transferred to, or seconded for duty with, the Royal Australian Army Medical Corps.

 

Employment of officers of the Active Forces or Regular Army Special Reserve.

“551. Officers of the Active Forces or the Regular Army Special Reserve in the Royal Australian Army Medical Corps may be allotted for duty with units and staffs of the Military Forces.

Examinations.

“552. The syllabus and scope of the examinations for appointment and promotion in the Royal Australian Army Medical Corps shall be as approved by the Military Board.

Exercise of military command.

“553. A member of the Royal Australian Army Medical Corps is not entitled to exercise any military command outside that Corps except over members who—

(a) are attached to that Corps for duty;

(b)are detailed for duty under his orders;

(c) are specially placed under his command;

(d)arc patients in a military hospital or other military medical establishment; or

(e) are under his professional care.

Appointment to Reserve of Officers.

“554.—(1.) A person who—

(a)is qualified under sub-regulation (2.) of regulation 120 of these Regulations to be appointed to commissioned rank in the Reserve of Officers by reason that he is qualified for appointment, in accordance with this Division, as an officer of the Active Forces in the Royal Australian Army Medical Corps; and

(b) is competent to perform the duties of an appointment in that Corps specified in column 1 of the table in this sub-regulation,

may be appointed as an officer of the Reserve of Officers in the Royal Australian Army Medical Corps, and may be granted the honorary rank specified in column 2 of that table opposite to that appointment.

“(2.) Officers of the Reserve of Officers in the Royal Australian Army Medical Corps may be employed from time to time on such medical duties as the Military Board approves.

 

Division 4.—Royal Australian Army Dental Corps.

Constitution of Corps.

“555. The Royal Australian Army Dental Corps shall consist of officers and soldiers who—

(a) are appointed to, or enlisted in, that Corps; or

(b) are transferred to, or seconded for duty with, that Corps from other parts of the Military Forces.

Prescribed Corps for the purposes of section 11a of the Act.

“556. The Royal Australian Army Dental Corps is a prescribed corps for the purposes of section 11a of the Act.

Appointment in accordance with this Division,

“557. Subject to this Division, a person shall not be appointed as an officer in, or, being an officer, shall not be transferred to, or seconded for duty with, the Royal Australian Army Dental Corps unless he is qualified for appointment as an officer of the Active Forces in that Corps in accordance with this Division.

Appointment of registered dentists, &c.

“558.—(1.) A person is qualified for appointment as an officer of the Active Forces in the Royal Australian Army Dental Corps if he is registered, or qualified to be registered, under a law of a State or Territory that provides for the registration of dentists.

“(2.) Where a person who—

(a) was appointed as an officer of the Australian Regular Army in the Royal Australian Army Dental Corps to the substantive rank of captain; and

(b) had, on appointment, the qualifications specified in sub-regulation (1.) of this regulation,

qualifies for promotion to the substantive rank of major, he may, notwithstanding regulation 85 of these Regulations, be promoted to the substantive rank of major after four years’ service in the rank of captain.

Appointment of person to fill vacancy.

“559. Notwithstanding regulation 557 of these Regulations, a person who is not qualified for appointment as an officer of the Active Forces in the Royal Australian Army Dental Corps in accordance with this Division but whose services are required to fill a vacancy on the authorized establishment of—

(a) a dental unit of the Military Forces; or

(b) the dental services of a head-quarters of the Military Forces,

may be appointed as an officer in, or, being an officer, may be transferred to, or seconded for duty with, the Royal Australian Army Dental Corps.

Employment of officers of the Active Forces.

“560. Officers of the Active Forces in the Royal Australian Army Dental Corps may be allotted for duty with units and staffs of the Military Forces.

(a) is qualified under sub-regulation (2.) of regulation 120 of these Regulations to be appointed to commissioned rank in the Reserve of Officers by reason that he is qualified to be appointed, in accordance with this Division, as an officer of the Active Forces in the Royal Australian Army Dental Corps; and

(b)is competent to perform the duties of an appointment in that Corps specified in column 1 of the table in this sub-regulation,

may be appointed as an officer of the Reserve of Officers in the Royal Australian Army Dental Corps, and may be granted the honorary rank specified in column 2 of that table opposite to that appointment.

Senior Jewish Chaplain.

9. Regulation 595b of the Australian Military Regulations is amended by adding at the end thereof the following sub-regulation:—

“(3.) The Senior Jewish Chaplain may be appointed a chaplain, 1st class.”.

10. Regulation 595c of the Australian Military Regulations is repealed.

Senior Chaplains.

11. Regulation 596 of the Australian Military Regulations is amended by omitting sub-regulations (2.) and (3.).

12. Regulations 609c and 609d of the Australian Military Regulations are repealed and the following regulations inserted in their stead:—

Prescribed corps for the purposes of section 11a of the Act.

“609c. The Australian Army Psychology Corps is a prescribed corps for the purposes of section 11a of the Act.

Accelerated promotion.

“609d. An officer of the Australian Regular Army in the Australian Army Psychology Corps who has not completed four years’ service in the substantive rank of lieutenant but who—

(a)is an Associate of the British Psychological Society; and

(b)has qualified for promotion to the substantive rank of captain, may, notwithstanding regulation 85 of these Regulations, be promoted to the substantive rank of captain.”.
