STATUTORY RULES.
REGULATIONS UNDER THE DEFENCE ACT 1903-1918.

over the Commonwealth of Australia, acting with the advice of the Federal
Executive Council, hereby make the following Regulations under the

Australian Military Regulations 1916.
A. Regulation 37 is repealed and the following regulation substituted in lieu thereof:—
“37. An officer of the Military Forces who has been provisionally promoted to a higher rank without his having previously passed the prescribed examination for that rank shall be required to pass the prescribed examination within a period of eighteen months from the date of his promotion or, if that period expires during time of war, within such period not exceeding eighteen months from the cessation of the time of war as the Military Board approve, and if he fails to do so his provisional appointment in that rank shall be terminated.”
B. Regulation 52a is amended by deleting in
para. (
C. Regulation 53 is repealed and the following regulation substituted in lieu thereof:—
“53. (1) Members of the Permanent and Citizen Forces and other persons eligible under section 148 of the Act may be appointed to commissioned rank in the Survey Section—Engineers (Permanent) provided that they—
(
a ) are between the ages of 20 and 45 years; and(
b ) are certified by a Medical Board to be physically qualified; and
For appointment, as Officers in the Survey Sub-section—
(
c ) have had two years’ experience as topographers in the field; and(
d ) have a knowledge of the principles of map projection and produce such evidence of competence and experience in triangulation as is required by the Military Board; and
For appointment as Officers in the Drafting-Sub-section—
(
e ) have had three years’ experience as Draftsmen; and(
f ) have a knowledge of geodetic calculations and map projections; and(
g ) produce such evidence of competence and experience in topographical drafting, and map production as is required by the Military Boards.
(2) Applicants before appointment as Officers of the Survey or Drafting Sub-section shall be required to pass the examination approved by the Military Board.
(3) First appointment in the Survey Section—Engineers (Permanent), shall be to the rank of Lieutenant.
(4) A Lieutenant in the Survey Section—Engineers (Permanent) may after four years’ service in that rank be promoted to the rank of Captain, subject to—
(
a ) The recommendation of the Chief of the General Staff; and(
b ) (i) Being a Survey Officer in the Survey Sub-section, his having passed the examination for a licensed surveyor; or(ii) Being a Survey Officer in the Drafting Sub-section, his having passed the examination approved by the Military Board.
D. The following new regulation is inserted next after regulation 140, to take effect as from 1st July, 1922 :—
“140a. An Officer of the Staff Corps who has graduated at the Military College (and) whose appointment in that Corps is terminated may with the approval of the Military Board be placed upon the Unattached List without his being required to have served for not less than five years as an Officer in a regiment or corps.”
E. Regulation 152.—Sub-section (1) is amended by inserting next after—

Officers of the Survey Section—Engineers (Permanent) :—

Captain.......................................................... 57”.
F. Regulation 150 is repealed and the following regulation substituted therefor:—
“159. (1) Officers on the Reserve of Officers List and Officers on the Retired List shall report their addresses annually in writing during the month of January or February to the Base Commandant of the Military District in which they reside. Officers on the Reserve of Officers List shall, in addition, report in writing to the Base Commandant any changes of their addresses, other than those of a temporary nature as they occur.
An Officer on the Retired List, who fails to comply with the provisions of this sub-regulation is liable to have his name removed from the List.
(2) Officers on the Unattached List shall report their addresses annually in writing, during the month of January or February, and also, as they occur, any changes of their addresses other than those of a temporary nature. These reports shall be made to the “formation, &c, commander” in whose command they were last serving. If an Officer changes his place of residence from one Military District to another, in which there is no portion of any division in which he is enrolled, he shall, on the receipt of his report, be transferred to a suitable division or mixed brigade or to the District Base in that other district according to the locality of his residence and his arm of the service and his subsequent reports shall be made to the “formation, &c., commander” to whose command be has been transferred.
An Officer on the Unattended List or the Reserve of Officers List, who fails to comply with the provisions of this regulation, is liable to be retired, and, if eligible, placed upon the Retired List.”
G. Regulation 727 is amended by inserting the words “or a member of the Citizen Forces on duty” next after the words “on or off duty”.
H. Regulations 1058 to 1084 inclusive are repealed.
I. Regulation 1217 is amended by—
(
a ) adding the following paragraph at the end of sub-regulation (2) thereof:—(
d ) In the case of the promotion of a Senior Cadet in respect of whom the annual training under Part XII. of the Act has been wholly suspended in any previous year, the period of service required of him under paragraphs (a ) and (b ) before his promotion may be diminished by one year for each annual training so suspended.(
b ) by repealing sub-regulations (3) and (4) and substituting the following sub-regulation:—(3) The syllabus and scope of the examinations for promotion to non-commissioned rank and to the rank of Cadet Second Lieutenant in the Senior Cadets shall be as approved by the Military Board.
J. Regulation 1224 is repealed and the following regulation substituted therefor:—
“1224. The syllabus and scope of the examination for appointment and promotion to the ranks of Lieutenant and Captain shall be as approved by the Military Board”.
K.Regulation 1229 is amended by adding the following sub-regulation at the end thereof:—
“(6), Officers on the Retired List, Senior Cadets, shall report their addresses annually in writing during the month of January or February to the Base Commandant of the Military District in which they reside. An Officer who fails to comply with the provisions of this sub-regulation is liable to have his name removed from the List.”
L. Regulation 1232 is amended, by repealing sub-regulation (3). thereof and substituting the following sub-regulation:—
“(3) Officers on the Unattached List, Senior Cadets, shall report their addresses annually in writing during the month of January or February and also, as they occur, any changes of their addresses other than those of a temporary nature. These reports shall be made to the commander of the division or mixed brigade in a unit of which they were last serving. If an Officer changes his place of residence from one Military District to another inwhich there is no portion of any division in which he is enrolled, he shall on the receipt of his report be transferred to a suitable division or mixed brigade in that other district according to the locality of his residence and his subsequent reports shall be made to the commander of the division or mixed brigade to which he has been transferred:
An Officer who fails to comply with the provisions of this sub-regulation is liable to be retired, and if eligible, placed upon the Retired List, Senior Cadets”.
