REGULATIONS UNDER THE DEFENCE ACT 1903-1939.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1939.

Amendments of the Australian Military Regulations. 

Subdivision of Regulation.

1.Regulation 2 of the Australian Military Regulations is amended by inserting after the words and figures—

“Division 12.—Provost Staff ........................... 608-609”,

the words and figures—

“Division 12A.—Australian Army Provost Corps.. 609a”.

Precedence of Corps.

2.Regulation 68 of the Australian Military Regulations is amended by inserting, below the words “The Australian Engineer and Railway Staff Corps,” the words “The Australian Army Provost Corps,”.

When seconded.

3.Regulation 109 of the Australian Military Regulations is amended—

(a) by omitting from paragraph (f) of sub-regulation (1) the word “or”; and

(b) by inserting in that sub-regulation, after paragraph (g), the following paragraph:—

“or (h) on attachment to the Australian Army Provost Corps.”.

Powers of provost-marshals, &c.

4.Regulation 235 of the Australian Military Regulations is amended—

(a) by omitting from sub-regulation (1) the word “or” (first occurring);

(b) by inserting in that sub-regulation, after the words “assistant provost-marshal” (first occurring), the words “any member of the Australian Army Provost Corps,”;

(c) by omitting from sub-regulation (2) the word “or” (first occurring) and inserting in its stead the word “, an”; and

(d) by inserting in that sub-regulation, after the words “assistant provost-marshal”, the words “or any member of the Australian Army Provost Corps”.

Military police.

5. Regulation 236 of the Australian Military Regulations is amended—

(a) by inserting in sub-regulation (1), after the words “military police”, the words “or members of the Australian Army Provost Corps”;

(b) by adding at the end of sub-regulation (2) the words “or by a member of the Australian Army Provost Corps”;

(c) by omitting from sub-regulation (3) the word “or” and inserting in its stead the word “, an”; and

(d) by adding at the end of that sub-regulation the words “or an officer of the Australian Army Provost Corps.”.

6.After regulation 609 of the Australian Military Regulations the following heading and regulation are inserted:—

Division 12a.—Australian Army Provost Corps.

Constitution of Corps in time of war.

“609a. In time of war there shall be an Australian Army Provost Corps which shall constitute a corps of the Permanent Forces and shall consist of officers and soldiers appointed to or enlisted in that Corps, or transferred to, or seconded for duty with, that Corps from other portions of the Military Forces.”.
