REGULATION UNDER THE DEFENCE ACT 1903-1915.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Defence Act 1903-1915 to come into operation forthwith.

The Australian Military Regulations 1916, dated 28th July, 1916, (Statutory Rules 1916, No. 166) are amended by inserting after Division 5 of Part V. thereof the following new Division 5a (Regulation 58a) (to take effect from 1st July, 1917):—

Division 5a.—Physical Training Instructional Staff.

Physical Training Instructional Staff.

58a. (1) The Physical Training Instructional Staff may be established as a portion of the Instructional Staff of the Australian Military Forces. It may comprise such officers as may be appointed thereto.

(2) The appointments of officers on the Physical Training Instructional Staff shall be limited to one Chief Instructor, and such instructors and assistant instructors as may be laid down from time to time.

(3) Officers of the Physical Training Instructional Staff may be recommended for such Honorary Commissions in the Permanent Forces as are determined by the Military Board.

(4) An Officer of the Physical Training Instructional Staff appointed prior to 1st July, 1914, or who holds a commission in the Militia Forces, Senior or Junior Cadets, at the date of his appointment to the Physical Training Instructional Staff, if the date of such commission is of a date prior to 1st July, 1914, may be granted a substantive commission on the Unattached List, on qualifying for his rank under the Syllabus and conditions which apply to officers of the Militia Forces, and may be retained thereon so long as he complies with the condition prescribed in Australian Military Regulation 143.

(5) An Officer of the Physical Training Instructional Staff granted a substantive commission under the latter part of sub-Regulation 4 of this Regulation, will not be permitted to retain it when promoted to a

higher rank in the Physical Training Instructional Staff unless he shall have qualified for such higher rank in accordance with the Syllabus and conditions which apply to officers of the Militia Forces.

(6) Australian Military Regulation 152 relating to age for retirement, shall not apply to officers of the Physical Training Instructional Staff, who will be retired on reaching the age of sixty years.

(7) The duties of the Physical Training Instructional Staff shall be as determined by the Military Board.
