REGULATIONS UNDER THE DEFENCE ACT 1903-1917.

I, SIR ARTHUR LYULPH STANLEY, Governor of the State of Victoria and its Dependencies, acting as the Deputy of the Governor-General in accordance with the provisions of the Constitution, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1917 to come into operation forthwith.

The Australian Military Regulations 1916 are amended as follows:—

A. 578/1/7

Regulation 173.—Delete sub-Regulation (3) and substitute the following:—

(3) Vacancies existing on the Instructional Staff for first appointments thereto will be filled by successful candidates according to the order of merit in which they—

(a) passed the qualifying examination at the school,

(b) satisfied the Chief of the General Staff that they possessed the necessary qualifications (section 21b, Defence Act).

Candidates will be discharged from the school if, at its conclusion, they fail to secure an appointment on the Instructional Staff.

Successful candidates will be appointed on probation for a period of one year, with the rank of Acting Staff Sergeant-Major. At the conclusion of this period they will, if favorably reported upon, be promoted to the rank of Warrant Officer, Class II., or discharged from the Instructional Staff if the report of the District Commandant is of an adverse nature.

Regulations 195 and 196 are repealed, and the following new Regulations made in lieu thereof:—

195. (1) The following will be the order of precedence of Warrant and Non-Commissioned Officers. Those bracketed together rank with one another according to the dates of promotion or appointment:—

(a) Warrant Officers, Class I.

Garrison Sergeant-Major.

Master Gunner, 1st Class

Master Gunner, 2nd Class.

Staff Regimental Sergeant-Major.

Brigade or Regimental Sergeant-Major.

*Bandmaster.

*Armament Sergeant-Major.

*Mechanist Sergeant-Major.

*Other Warrant Officers, Class I., not elsewhere included.

(b) Warrant Officers, Class II.

Master Gunner, 3rd Class.

Staff Sergeant-Major.

Brigade or Regimental Quartermaster-Sergeant.

*Armament Quartermaster-Sergeant.

*Mechanist Quartermaster-Sergeant.

Squadron, Battery, Troop, or Company Sergeant-Major.

(c) Non-Commissioned Officers.

Staff Sergeant.

Squadron, Battery, Troop, or Company Quartermaster-Sergeant.

*Barrack Sergeant.

(2) Non-Commissioned Officers of the Permanent Forces holding the rank of Squadron, Battery, Troop or Company Quartermaster-Sergeant at the date of this regulation coming into operation, will, for the purposes of promotion to Warrant Officer, Class I., retain their existing seniority on promotion lists.

(3) Armament, Armourer, Artificer, Collar-maker, Farrier, Mechanist, Pioneer, Saddler, Shoeing-smith and Wheeler, Non-Commissioned Officers take precedence according to their rank as Quartermaster-Sergeant, Sergeant, &c.

(4) Warrant and Non-Commissioned Officers against whose names an asterisk (*) is placed are not entitled to assume any command on parade or duty, except over such Warrant Officers, Non-Commissioned Officers, and men as may be specially placed under their orders. In matters of discipline, however, they will, at all times, exercise the full authority attached to their rank.

(5) Classification for pay shall not affect the above classification for purposes of command and precedence.”

196. The appointments held by Warrant Officers, Non-commissioned Officers, and men of the Military Forces, set forth in the following table, confer upon the holder the rank specified opposite that appointment in the table:—
