REGULATIONS UNDER THE DEFENCE ACT 1903–1915

THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with,
the advice of the Federal Executive Council, hereby make the following
Regulations under the

Amendment of the Australian Military Regulations 1916.
The Australian Military Regulations 1916 are amended as follows:—
(1) In Regulation 3, Part V.,
(
a ) cancel the words—“Division 2.—Appointment to First Commissions in the Administrative and Instructional Staff, Royal Australian Artillery, Royal Australian Engineers, and Australian Survey Corps, &c.”.
and substitute, therefor the following words:—
“Division 2.—Staff Corps”;
(
b ) cancel the words—“Division 3.—Appointment of Graduates from Royal Military College.”,
and substitute therefor the following words:—
“Division 3.—Appointment to Commissioned Rank for the position of Quartermaster of Warrant and Non-Commissioned Officers of the Permanent Forces who are not graduates of the Royal Military College”.
(
c ) insert immediately below the words—“Division 3 ” the words—
“Division 3a—Survey Section Engineers, (Permanent)”.
(
d ) cancel the words—“Division. 6—Adjutants and Quartermasters”.
(
e ) cancel the words—“Division 17—Duration of Appointments on Administrative and Instructional Staff.”
(2) Cancel the heading—
“Division 2—Appointment to First Commissions in the Administrative and Instructional Staff, Royal Australian Artillery, Royal Australian Engineers, and Australian Survey Corps”,
next following Regulation 37 and substitute therefor, the following heading:—
“Division 2—“Staff Corps”.
(3) Cancel Regulations 38 to 49, both inclusive, and substitute therefor the following regulations:—
38. The Staff Corps shall constitute a corps of the Permanent Military Forces, and shall consist of officers other than Quartermasters, appointed to substantive commissioned rank in the Permanent Military Forces for duty with the following
branches of those forces, namely, the Administrative and Instructional Staffs, the Artillery, the Engineers (other than the Survey Section), and the Army Service Corps.
39. Staff cadets on graduation at the Royal Military College shall be appointed to commissioned rank in the Staff Corps and be granted the rank of Lieutenant on first appointment.
40. (i) Officers of the Staff Corps shall be borne on one seniority list.
(ii) The seniority of officers, in the Staff Corps shall be regulated according to the dates and ranks of their appointment to or promotion in the Permanent Military Forces, and, when such appointments or promotions are of the same date, by their seniority immediately prior to their appointments or promotions, or in the case of first appointments in the Staff Corps by the order in which their names appear in the
Gazette in which their appointments are notified.41. Officers of the Staff Corps may be allotted for duty with Administrative and Instructional Staffs, the Staffs of Military Colleges and Schools, the Royal Australian Artillery, the Royal Australian Engineers, the Australian Army Service Corps (Permanent), and with the Staffs and Units of the Citizen Forces as approved by the Military Board.
42. An officer of the Staff Corps, unless reappointed, shall not hold the appointment of Inspector-General or an appointment on the Staff of the Inspector-General for a longer period than four years.
43. An officer of the Staff Corps, unless reappointed, shall not hold the same appointment on any Head-quarters Staff or the Head-quarters of any unit or formation or the Staff of the Royal Military College or of a Military School for a longer period than four years.
44. Regulations 42 and 43 shall apply to officers holding appointments referred to therein notwithstanding that any such appointments were made prior to the passing of those regulations.
45. On appointment to the Staff Corps officers who have graduated at the Royal Military College will be attached for a tour of duty to units of the British or Indian Army subject to the necessary funds being made available by Parliament.
46. The Adjutant-General will inform the Commandant, Royal Military College, by the first of December in each year of the estimated requirements in the Staff Corps for Lieutenants for the several arms twelve months later.
47. (i) The officer commanding any unit or corps of the Permanent Military forces shall, for thepurpose of discipline and during the period of their allotment, be the Commanding Officer of such officers of the Staff Corps as are allotted, for duty with that unit or corps.
(ii) For purposes of discipline the Commanding Officer of officers of the Staff Corps, other than those allotted for duty with any unit or corps of the Permanent Military Forces except for purposes of commanding such units or corps shall be—
(
a ) In respect of officers serving under an officer appointed by the Military Board to command any portion of the Staff Corps—the officer so appointed to command.(
b ) In respect of officers serving, under a District Commandant or the Commandant of the Royal Military College—the District Commandant or the Commandant, Royal Military College, as the case may be.(
c ) In respect of officers not serving under a District Commandant, the Commandant, Royal Military College, or an officer referred to in paragraph, (a ) above—the Adjutant-General:(iii) For the purposes of appointment, promotion and transfer, officers of the Staff Corps shall be under the administration of the Adjutant-General.
(4) Cancel the heading—
“Division 3—Appointment of Graduates from the Royal Military College” next preceding regulation 50
and regulations 50 to 53, both inclusive,
and substitute therefor the following:—
“Division 3—Appointment to Commissioned Rank for the position of Quartermaster of “Warrant and Non-Commissioned Officers of the Permanent Forces who are not graduates of the Royal Military College.”
48. “Warrant and Non-Commissioned Officers of the Permanent Military Forces may be appointed, under the provisions of section 148 of the Act to the position of Quartermaster with substantive commissioned rank in the Administrative and Instructional Staff, the Royal Australian Artillery, the Royal Australian Engineers, the Army Service Corps or in units of Services and Departments, and they may be allotted for duty with units of the Citizen Forces.
49. As a temporary measure a limited number of “Warrant and Non-Commissioned Officers of the Permanent Forces who hold commissioned rank in an Australian Expeditionary Force may be appointed to the position of Quartermaster with honorary commissioned rank in the Administrative and Instructional Staff, and allotted for duty with units of the Citizen Forces.
50. (i) As a temporary measure a further limited number of “Warrant and Non-Commissioned Officers of the Permanent Military Forces who hold commissioned rank in an Australian Expeditionary Force may be appointed temporarily to the position of Quartermaster with temporary and honorary commissioned rank in the Administrative and Instructional Staff and allotted for duty with units of the Citizen Forces at a fixed rate of pay.
(ii) A temporary appointment under sub-regulation (i) above may be terminated at any time, but if on such termination a member of the Permanent Military Forces continues to serve in those Forces as a Warrant or Non-Commissioned Officer, the period of his service in that temporary appointment shall be reckoned as service in Warrant or Non-Commissioned rank for the purpose of all privileges accruing to such service.
51. (i) Regulation 97 shall not apply to Members of the Permanent Military Forces appointed under the provisions of Regulations 49 and 50.
(ii) No further appointments shall be made under the provisions of Regulations 49 and 50 after the thirty-first of October, 1920.
52. Warrant and Non-Commissioned Officers of the Permanent Military Forces appointed to commissioned rank in those Forces for the position of Quartermaster may be required to perform, in addition, to the duties; of Quartermaster, such other duties as may be ordered by the Military Board.
53. (i) Members of the Permanent and Citizen Forces or persons who have served with satisfactory record in any Expeditionary Force raised for service outside the Commonwealth and who are not graduates of the Royal Military College may be appointed to commissioned rank in the Survey Section—Engineers (Permanent) provided that—
(
a ) They are between the ages of 20 and 45 years.(
b ) They are certified by a Medical Board to be physically qualified.(
c ) They have had two years experience as topographers in the field.(
d )They have had two years experience in triangulating either in the Australian Survey Corps, or in a similar Corps in another part of the Empire, or as surveyors or assistants to a surveyor.(
e ) They have passed the necessary examination.(ii) The subjects and scope of the examinations shall be as set out from time to time in Military Orders.
(iii) Notice of vacancies in the Survey Section—Engineers (Permanent) shall be given by advertisement in the Press in all Military Districts and in Military Orders. Should there be more candidates than vacancies the examination shall be competitive.
(iv) First appointment in the Survey Section—Engineers (Permanent) shall be to the rank of Lieutenant.
(v) Officers of the Survey Section—Engineers (Permanent) will not be eligible for transfer to the Staff Corps, or to other sections of Engineers (Permanent).
(5) Cancel the heading—
“Division 6—Appointment to commissioned rank for the position of Quartermaster of Warrant and Non-Commissioned Officers of the Permanent Forces who are not graduates of the Royal Military College,”

(6) Cancel Regulation 59.
(7). Cancel the heading—
“Division 17—Duration of Appointments on the Administrative and Instructional Staff”
next following Regulation 101.
