AUSTRALIAN MARITIME COLLEGE TRAFFIC AND PARKING RULES

Pursuant to the Traffic And Parking Statute 1999, the Council hereby:

(a) repeals the "Traffic and Parking Rules" made on the seventeenth day of March 2000 under the General Management Statute; and

(b) makes the following Rules.

1Citation

1.1 These rules may be cited as the Traffic and Parking Rules.

2Definitions

2.1 In these Rules unless a contrary intention is indicated:

"AMC grounds" includes the grounds of all facilities operated by the AMC.

"Driver" means a person in charge of a vehicle present on AMC grounds.

  1. "Vehicle" means any contrivance designed to carry a person or persons and to move on one or more wheels or revolving runners, including a motor vehicle.

    "Motor vehicle" means a vehicle normally propelled or capable of being propelled by any means other than animal power.

    "Motor cycle" means a motor vehicle, which is a bicycle or tricycle.

    "AMC vehicle" means a vehicle owned, hired or operated by the AMC.

  2. "Staff vehicle" means a vehicle other than an AMC vehicle in the charge of a member of the staff of the AMC.

    "Visitor's vehicle" means a vehicle other than an AMC vehicle in the charge of a person other than a student or member of the staff of the AMC.

    "Resident's vehicle" means a vehicle other than an AMC vehicle in the charge of a resident of a Hall of Residence of the AMC.

    "Traffic sign" means a sign erected by the Corporate General Manager/Registrar or an Officer of the AMC and displaying instructions to drivers, other than instructions relating to the parking of vehicles.

    "Parking sign" means a sign erected by the Corporate General Manager/Registrar or an officer of the AMC and displaying instructions to drivers relating to the parking of vehicles on AMC grounds.

    "Officer of the AMC" means a member of the staff appointed by the Corporate General Manager/Registrar under Rule 3.1 of these Rules.

  3. “The Policy”

    means AMC Policy PF14 Traffic and Parking Policy.

    2.2 The "AMC grounds" are hereby prescribed as facilities for the purposes of the Traffic And Parking Statute.

3Procedures

3.1 The Policy shall appoint in writing one or more personnel as Officers of the AMC to control vehicle movement and parking for the purposes of these Rules. Officers of the AMC shall be clearly identified as such by means of an identification card consisting of an image of the persons’ head and shoulders, and their name.

3.2 An Officer of the AMC will conduct random inspections of AMC grounds to ensure vehicles are parked in accordance with these Rules and the Policy.

3.3

There is to be an escalating procedure for managing illegally parked vehicles that ranges from, but is not limited to, written warnings through to fines and banning vehicles from parking on AMC grounds.

3.4

Where it is deemed necessary by an Officer of the AMC for reasons of safety, access to facilities or persistent violation of these Rules, the Corporate General Manager/Registrar shall approve the forceful removal or wheel clamping of offending vehicles, for release at the owner’s expense.

4Responsibilities of Drivers

4.1 A driver shall:

  1. (a)

    drive in a safe and responsible manner, cognisant of road and climatic conditions, pedestrian traffic and other road users;

  2. (b)

    drive in such a way as to comply with the traffic and road laws as they apply in the State of Tasmania;

  3. (c)

    comply with the directions of Officers of the AMC appointed under Rule 3.1; and

  4. (d)

    comply with the directions displayed on traffic and parking signs on AMC grounds.

5Parking

5.1 The Policy shall designate in writing areas within the AMC grounds in which the parking of vehicles is permitted and under what conditions, and shall determine each such area to be for one or more of the following purposes:

(a) general parking;

(b) parking of AMC vehicles;

(c) parking of visitors' vehicles;

(d) parking of staff vehicles;

(e) parking of residents' vehicles;

(f) parking of motorcycles;

(g) parking of bicycles;

(h) special purpose parking.

  1. 5.2

    The Corporate General Manager/Registrar shall cause there to be a plan specifying parking areas designated as:

  2. (a)

    Permit Parking (‘Staff Only’ and ‘Residents Only’), for which there is to be an annual fee specified in the Policy and subject to review on an as required basis;

  3. (b)

    Pay and Display Parking, for general use by staff and students, conducted in collaboration with a contracted third party;

  4. (c)

    Visitor Parking, for use by visitors for periods not exceeding one hour;

  5. (d)

    Handicapped Parking, for use by persons recognised as requiring access to dedicated parking facilities due to their disability;

  6. (e)

    Drop-off Point, for delivering passengers to the AMC but not for the parking of vehicles.

    5.3 The Corporate General Manager/Registrar shall ensure that the Parking Area Plan is displayed in a prominent position on notice boards at Newnham and Beauty Point campuses and may make variations or additions to areas designated under Rule 5.1. as required. The Parking Area Plan is to be amended to reflect all variations or additions and promulgated within 20 working days of the change.

    5.5 A driver shall park a vehicle only in an area designated under Rule 5.1 and in accordance with the specific purpose for which that area has been designated.

    5.6 A driver shall not park a vehicle on AMC grounds for an unbroken period in excess of 14 consecutive days without having first obtained approval in writing from the Corporate General Manager/Registrar.

    5.7 Staff and student drivers must prominently display an AMC permit with the current year on any vehicle under their control parked in AMC designated parking areas.

    5.8 The holder of a permit is guilty of an offence against these Rules if that holder contravenes, or fails to comply with, a condition to which the permit is subject.

    5.9 Vehicles parked in the area designated as the Visitor Parking Area must display a current Visitor Parking Permit as detailed in the Policy.

6Penalties

6.1 A driver who contravenes the AMC Traffic and Parking Rules shall be liable to disciplinary action as determined by Rule 8.1 and as specified in the Policy.

6.2 Notice of the imposition of a fine under Rule 6.1 shall be delivered in writing from an Officer of the AMC, or the contracted third party, to the driver by attaching such notice in a conspicuous location on the vehicle concerned.

6.3 Where in the opinion of an Officer of the AMC a driver contravenes Rule 4 of these Rules, that Officer shall report details of the incident to the Corporate General Manager/Registrar who shall determine whether action shall be taken under Rule 6.4.

6.4 Where in accordance with Rule 6.3 the Corporate General Manager/Registrar determines that action shall be taken under this Rule, he/she shall give written notification to the driver inviting him/her to show cause within 14 days from the date of the notification why he/she should not be prohibited from bringing a vehicle onto the campus.

6.5 As soon as practicable after the expiration of fourteen days from the date of any notification under Rule 6.4, the Corporate General Manager/Registrar shall enquire into the circumstances of the incident and shall consider any evidence provided by the person to whom the notification was issued and shall:

(a) determine whether that person shall be prohibited from bringing a vehicle onto AMC grounds;

  1. (b)

    determine the period of any such prohibition; and

(c)

notify in writing the person in respect of whom any determinations have been made under paragraphs (a) and (b) of this Rule.

6.6 A person who has received a notification under Rule 6.5 (c) that he/she has been prohibited from bringing a vehicle onto AMC grounds shall not bring a vehicle onto AMC grounds during the period of prohibition specified in that notification. Where the persons fails to comply with the notification then the Corporate General Manager/Registrar is to take action in accordance with Rule 3.4.

7Skateboards/rollerblades/roller-skates

7.1 A person must not use a skateboard, rollerblades or roller-skates on AMC grounds other than in the course of a special event approved by the Corporate General Manager/Registrar in the area designated for that event.

8Scale of Fines

8.1 The Corporate General Manager/Registrar shall determine a standard scale of fines and ensure they are published in the Policy. These fines are to be reviewed as required to ensure their appropriateness in achieving vehicle-parking compliance.

8.2 The Corporate General Manager/Registrar shall cause the scale of fines to be displayed alongside the plan specified in Rule 5.3.
