Australian Maritime College Rules for AMC Residences (23/09/2005) (Cth)
Pursuant to the General Management Statute, the Council hereby:
(a) repeals the "Rules for Residents" made on the sixteenth day of September 1999; and
(b) makes the following Rules.

These Rules may be cited as the Rules for AMC Residences.
The Rules for AMC Residences apply to all persons accommodated in Halls of Residence of the Australian Maritime College.
3.1 The day-to-day operation of the Halls of Residence is the responsibility of the Master of Residences.
3.2 Accommodation fees shall be approved by the Council from time to time. Except in the case of overnight and short-term guests, a resident shall pay accommodation fees fortnightly in advance of the date upon which fees fall due and shall provide four weeks notice of vacating. Payment of initial accommodation fees, together with a bond as determined by the AMC from time to time, are required before a room will be allocated.
3.3 A resident required to vacate the Halls of Residence due to prolonged illness shall not be liable for accommodation fees during his/her absence.
3.4 Rooms shall be allocated by the Master of Residences. No changes in room allocation shall be made without the prior approval of the Master of Residences.
3.5 A resident shall be provided with a room and a key allocated to that resident. A resident must report the loss of a key to the Master of Residences within 24 hours or when aware, whichever is earliest. No key shall be duplicated and residents shall return their keys to the Master of Residences upon termination of residence or upon demand. Keys are not interchangeable and residents shall not provide keys to non-residents and shall keep their rooms locked when absent. A fee will be charged for a replacement key.
3.6 A resident shall not remove furniture or fittings from rooms, nor from communal facilities, without the prior approval of the Master of Residences.
3.7 Responsibility for the contents of any room, including keys and the cost of rectifying any loss or damage, shall be borne by the person to whom the room is allocated. A resident shall report promptly any damage or malfunction in any furniture or fittings to the Master of Residences.
3.8 Residents shall maintain their rooms in a clean, tidy and hygienic state. Cooking is not permitted in residents rooms.
3.9 The AMC will not be liable for loss or damage to property of a resident unless that damage is due to gross negligence on the part of the AMC.
3.10 A resident shall not keep pets in the Halls of Residence or in the grounds of the AMC .
3.11 A resident shall not bring prohibited substances, firearms, ammunition, fireworks or other dangerous goods into the Halls of Residence or the AMC, nor have them in his/her possession on AMC premises. Residents are subject to the various laws applicable in Tasmania in relation to prohibited substances.
3.12 A resident under the age of 18 years shall not have in his/her possession, or consume, alcohol on the premises.
3.13 Any consumption of alcohol by residents 18 years or older in the Residential area shall be at the discretion of the Master of Residences'.
3.14 Smoking is not permitted in Halls of Residence, or within 10 metres of any door or window opening of a residential building.
3.15 In the grounds of the AMC, a resident shall not:
(a) park motor vehicles except in car parks provided for that purpose;
(b) drive motor vehicles except on roadways;
(c) drive a vehicle in a dangerous manner or in a way that will create undue noise.
3.16 Residents are not permitted to make outgoing calls through the College switchboard, or PABX.
3.17 Residents shall inform the Master of Residences or Residential staff on duty of any accident and any case of illness as soon as practicable.
3.18 Residents shall ensure that their room doors are securely locked when absent from their room and that windows are secure. A resident shall report to the Master of Residences the presence of any suspicious person observed upon AMC premises.
3.19 The Halls of Residence shall designate quiet hours which will be strictly enforced. During quiet hours, residents and their guests shall not disturb others.
3.20 A resident shall not misuse the firefighting equipment. In case of fire, residents are to follow the emergency procedures displayed in each residential block and must obey the instructions of any nominated fire warden.
3.21 With the prior approval of the Registrar, the Master of Residences may establish domestic regulations consistent with these Rules for the effective conduct of the Halls of Residence. Any such regulations shall be drawn to the attention of all residents by the Master of Residences and shall be complied with by all residents.
4.1 Breaches of these Rules or any behaviour causing inconvenience to others or which is prejudicial to the good order and management of the Halls of Residence or the College may result in disciplinary action being taken.
4.2 A breach of the Rules will be drawn to the attention of the resident concerned by the issue of a written warning by the Master of Residences, a copy of which will be provided to the Registrar
. Any further breach of the Rules may result in that resident being required by the Master of Residences to vacate the Halls of Residence. Any person required to vacate shall be given written notification of the decision by the Master of Residences and shall vacate within five days of receipt of the notification. The Master of Residences shall, as soon as practicable after taking such action, notify the Registrar. This does not preclude the AMC from taking additional disciplinary action in accordance with the Student Conduct Rules.4.3 Notwithstanding the provisions of 4.2 above, when in the opinion of the Master of Residences a resident is guilty of gross misconduct, the Master of Residences, by notification in writing, may require the resident to vacate the Halls of Residence within twenty four hours. As soon as practicable after taking such action, the Master of Residences shall notify the Registrar.
4.4 The Registrar may also take any one or more of the following courses of action as considered appropriate:
(a) order the student to make restitution for any damage or loss of property involved;
(b) suspend the student from all classes for a period not exceeding one calendar month, provided that any such suspension shall not apply during the currency of examination;
(c) refer the matter forthwith to the Disciplinary Committee established under the Student Disciplinary Rules.
4.5 A resident who has received a notification to vacate may appeal to the President, but any such appeal shall not operate as a stay of proceedings. Appeals shall be made in writing stating briefly the grounds of the appeal and shall be forwarded to the President.
4.6 Where the President receives an appeal by a resident against a decision made by the Master of Residences or Registrar under these Rules, he/she may require the resident to appear before him/her and may enquire into the matter. As a result of those enquiries, the President may confirm or set aside the decision and his/her decision is final.
