AUSTRALIAN MARITIME COLLEGE
FEES AND OBLIGATIONS RULES
Pursuant to the General Management Statute the Council hereby:
(a)repeals the “Fees and Obligations Rules” made on the eleventh day of June 1980 and amended on the eleventh day of June 1981; and
(b)makes the following Rules:

1 Citation
These rules may be cited as the Fees and Obligations Rules.
2 Definitions
In these Rules, unless the contrary intention appears:
“Fees” means amounts payable to the AMC pursuant to section 32 of the Act and
“Obligations” means charges, other than fees, as provided for in the General Management Statute.
3 Time and Manner of Payment of Fees
Fees and obligations shall be paid at such time and in such manner as the Registrar shall, after consultation with the relevant Manager/Program Head, determine.
4 Publication of Determinations
Where a determination is made by the Registrar pursuant to Rule 3 and where such determination relates to more than one student, the Registrar shall upon obtaining the approval of the Manager/Program Head concerned, publish such determination in such manner as the Registrar considers appropriate.
5 Extension of Time for Payment
Where by virtue of a determination as referred to in Rule 3, a student is required to pay fees or obligations by a certain date, such student may, prior to such date, apply in writing to the Registrar for an extension of the time limited for payment. The Registrar may extend the time for a payment which is the subject of the Application.
6 Student Association Fees
6.1A student other than a short course student:
(a) shall pay a facilities fee as determined by Council from time to time;
(b) in addition may, if she/he so elects, pay the AMC a membership subscription in respect of a student association.
6.2Subject to rule 6.3, where a student does not wish to join a student association she/he shall not be obliged to pay any membership subscription directly or indirectly to that association but shall have all the rights of a member of the association other than the right to participate in meetings of the association or to use the property of the association.
6.3A student referred to in Rule 6.2 shall upon payment of the facilities fee be entitled to use any facilities or to participate in any activity funded by that fee.
6.4Council may determine that the fee for a short course student includes an amount determined by Council for the use of facilities and, where such determination is made, a student undertaking such a course shall be entitled to use any facilities or to participate in any activity funded by the facilities fee.
7 Attendance at Activities without Fees
Where a fee or obligation is payable in advance in relation to a student’s attendance at a lecture, class, tutorial, excursion, examination or other activity of the AMC, a student in respect of whom such fee or obligation has not been paid shall not, without the permission of the Principal, attend such activity.
8 Issue of Certificate
8.1Where the Principal is satisfied that a person who is or has been a student is indebted to the AMC, the Principal may issue a Certificate stating that she/he is so satisfied and giving particulars of the relevant debt.
8.2Upon the issuing of a Certificate as referred to in 8.1, the Principal shall:
(a) forthwith cause a copy of the Certificate to be posted in a sealed envelope by pre-paid mail to the last address of such person to whom the Certificate relates as recorded in the records of the AMC;
(b) at the meeting of the Council next following the issue of the Certificate, cause the Council to be given particulars of the Certificate.
9 Revocation of Certificate
9.1If a person to whom a certificate relates ceases to be indebted to the AMC in respect of the debt referred to in the Certificate, such Certificate shall be deemed to be revoked.
9.2The Principal may, at any time, revoke a Certificate, and in such a case may cancel the debt to which it relates.
10 Appeals
The Principal’s decision is final and there is no right of appeal.
11 Effects of Certificate
11.1Notwithstanding anything in any other Statute or in Rules made thereunder, a person to whom a Certificate referred to in Rule 8 above relates is not entitled whilst the Certificate remains unrevoked:
(a) to be enrolled or re-enrolled as a student;
(b) to attend any lecture class, tutorial, excursion, examination or other activity;
(c) to have an award of the AMC conferred on him or her; or
(d) to be furnished with a document that states that she/he has completed the whole or part of a course.
